| Atlanta – Representative Virgil Fludd
(D-Fayetteville) recently announced his pleasure at the Georgia General
Assembly’s approval of HB 208, which passed during the 2004 session.
The legislation updates Georgia code governing the operation of property
owners’ associations to bring them in line with modern practices.
It allows absent members the option of voting by proxy, or written consent.
HB 208 also gives property owner associations the flexibility to implement
certain uniform charges for services, such as furnishing pool or laundry
keys, which are requested by the association’s members. Finally,
the legislation would allow for the use of e-mail to notify property
owners of upcoming association meetings.
Rep. Fludd also included language in his bill which would protect property
owners by ensuring that they receive at least 30 days prior notice before
an association can foreclose on a lien for payments of fees and property
owner assessments. The notice must specify the amount owed, including
interest and late charges.
“I’m glad that my colleagues joined me in passing HB 208,” said
Rep. Fludd. “It may not be flashy or high-profile, but it is a
nuts and bolts type issue, which both bodies of the General Assembly
considered important enough to ensure it was addressed before the final
gavel fell on the session’s 40th day. It will help the thousands
of Georgians who are involved in property owners’ organizations”
