                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Subpart 2 of Part 2 of Article 16 of Chapter 2 of 
  1- 2  Title 20, the "Public School Disciplinary Tribunal Act," so 
  1- 3  as to require that student codes of conduct include 
  1- 4  provisions addressing verbal assault, physical assault or 
  1- 5  battery, and disrespectful conduct toward teachers, 
  1- 6  administrators, other school personnel, other students, and 
  1- 7  persons attending school-related functions; to provide for 
  1- 8  the filing of such provisions with the State Board of 
  1- 9  Education and for their review as to form; to provide for 
  1-10  the distribution of student codes of conduct in conjunction 
  1-11  with student handbooks and for parents' and guardians' 
  1-12  acknowledgments of receipt; to provide for an effective 
  1-13  date; to repeal conflicting laws; and for other purposes. 
 
  1-14       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-15                           SECTION 1. 
 
  1-16  Subpart 2 of Part 2 of Article 16 of Chapter 2 of Title 20, 
  1-17  the "Public School Disciplinary Tribunal Act," is amended by 
  1-18  adding a new Code section, to be designated as Code Section 
  1-19  20-2-751.4, to read as follows: 
 
  1-20    "20-2-751.4. 
 
  1-21      (a)(1) Each student code of conduct shall contain 
  1-22      provisions that address the following conduct of 
  1-23      students during school hours and at school-related 
  1-24      functions, in a manner that is appropriate to the age of 
  1-25      the student: 
 
  1-26        (A) Verbal assault of teachers, administrators, and 
  1-27        other school personnel; 
 
  1-28        (B) Physical assault or battery of teachers, 
  1-29        administrators, and other school personnel; 
 
  1-30        (C) Disrespectful conduct toward teachers, 
  1-31        administrators, and other school personnel; 
 
  1-32        (D) Verbal assault of other students;

  2- 1        (E) Physical assault or battery of other students; 
 
  2- 2        (F) Disrespectful conduct toward other students; and 
 
  2- 3        (G) Verbal assault of, physical assault or battery of, 
  2- 4        and disrespectful conduct toward persons attending 
  2- 5        school-related functions. 
 
  2- 6      (2) No later than August 15, 2000, each local board of 
  2- 7      education shall send to the State Board of Education a 
  2- 8      copy of the provisions of its student code of conduct 
  2- 9      that address the items identified in paragraph (1) of 
  2-10      this subsection.  The state board shall review such 
  2-11      provisions to ensure that each of the items identified 
  2-12      in paragraph (1) of this subsection is addressed and 
  2-13      shall notify a local board of education, no later than 
  2-14      October 15, 2000, of any items which are not addressed 
  2-15      in its submission to the state board.  Nothing in this 
  2-16      subsection shall be construed as authorizing or 
  2-17      requiring the state board to review or approve the 
  2-18      substance of the student codes of conduct. 
 
  2-19    (b) Any student handbook which is prepared by a local 
  2-20    board or school shall include a copy or summary of the 
  2-21    student code of conduct for that school or be accompanied 
  2-22    by a copy of the student code of conduct for that school. 
  2-23    If a student handbook contains a summary of the student 
  2-24    code of conduct, then a full copy of the student code of 
  2-25    conduct shall be made available for review at the school. 
  2-26    When distributing a student code of conduct, a local 
  2-27    school shall include a form on which the student's parent 
  2-28    or guardian may acknowledge his or her receipt of the 
  2-29    code, and the local school shall request that the form be 
  2-30    signed and returned to the school." 
 
  2-31                           SECTION 2. 
 
  2-32  This Act shall become effective on July 1, 2000. 
 
  2-33                           SECTION 3. 
 
  2-34  All laws and parts of laws in conflict with this Act are 
  2-35  repealed.
