                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Part 2 of Article 2 of Chapter 4 of Title 38 of the 
  1- 2  Official Code of Georgia Annotated, relating to the War 
  1- 3  Veterans Home, so as to provide that a war veteran shall not 
  1- 4  be eligible for admission to the Georgia War Veterans' 
  1- 5  Nursing Home or the Georgia State War Veterans' Home unless 
  1- 6  such war veteran has been a resident of this state for a 
  1- 7  period of at least five years immediately prior to 
  1- 8  application for admission; to repeal conflicting laws; and 
  1- 9  for other purposes. 
 
  1-10       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-11                           SECTION 1. 
 
  1-12  Part 2 of Article 2 of Chapter 4 of Title 38 of the Official 
  1-13  Code of Georgia Annotated, relating to the War Veterans 
  1-14  Home, is amended by striking in its entirety Code Section 
  1-15  38-4-55, relating to admissions to and discharges from any 
  1-16  facility of the Georgia State War Veterans' Home, and 
  1-17  inserting in lieu thereof a new Code Section 38-4-55 to read 
  1-18  as follows: 
 
  1-19    "38-4-55. 
 
  1-20    Admissions to and discharges from any facility of the 
  1-21    Georgia State War Veterans' Home shall be under the 
  1-22    control of the governing authority of the facility 
  1-23    concerned under the laws and department rules and 
  1-24    regulations in force at the time application for admission 
  1-25    or for discharge is presented; provided, however, that a 
  1-26    war veteran shall not be eligible for admission to the 
  1-27    Georgia War Veterans' Nursing Home or the Georgia State 
  1-28    War Veterans' Home unless such war veteran has been a 
  1-29    resident of this state for a period of at least five years 
  1-30    immediately prior to application for admission; provided, 
  1-31    further, that the Veterans Service Board may admit and 
  1-32    discharge veterans to the Georgia State War Veterans' Home 
  1-33    who qualify for care and treatment under Title 38, U.S.C., 
  1-34    Section 101 (19) and Section 641 and may adopt appropriate

  2- 1    rules consistent with accepted medical considerations to 
  2- 2    carry out this function. The governing authority of such 
  2- 3    facility shall exercise appropriate police power and power 
  2- 4    of restraint over veterans at the Georgia State War 
  2- 5    Veterans' Home consistent with policies applied to other 
  2- 6    patients under their care or responsibility." 
 
  2- 7                           SECTION 2. 
 
  2- 8  All laws and parts of laws in conflict with this Act are
