actions involving the accident or motor vehicle still outstanding
or pending shall scrap, dismantle, demolish, or dispose of such
vehicle until such person has been notified that all insurance

A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 1 of Chapter 11 of Title 40 of the Official
1- 2 Code of Georgia Annotated, relating to general provisions
1- 3 applicable to abandoned motor vehicles, so as to provide
1- 4 that no person who is in possession of an abandoned or
1- 5 derelict motor vehicle which has been involved in an
1- 6 accident and who has been notified that there are insurance
1- 7 claims or civil actions involving the accident or motor
1- 8 vehicle still outstanding or pending shall scrap, dismantle,
1- 9 demolish, or dispose of such vehicle until such person has
1-10 been notified that all insurance claims or civil actions
1-11 involving the accident or motor vehicle have been settled or
1-12 concluded; to provide an exception; to provide a penalty for
1-13 a violation of this Act; to repeal conflicting laws; and for
1-14 other purposes.
1-15 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-16 SECTION 1.
1-17 Article 1 of Chapter 11 of Title 40 of the Official Code of
1-18 Georgia Annotated, relating to general provisions applicable
1-19 to abandoned motor vehicles, is amended by adding at the end
1-20 thereof a new Code Section 40-11-10 to read as follows:
1-21 "40-11-10.
1-22 (a) Notwithstanding any other provisions of this article,
1-23 no person who is in possession of an abandoned or derelict
1-24 motor vehicle which has been involved in an accident and
1-25 who has been notified that there are insurance claims or
1-26 civil actions involving the accident or motor vehicle
1-27 still outstanding or pending shall scrap, dismantle,
1-28 demolish, or dispose of such vehicle until such person has
1-29 been notified that all insurance claims or civil actions
1-30 involving the accident or motor vehicle have been settled
1-31 or concluded. The provisions of this subsection shall not
1-32 apply to a motor vehicle for which a claim has not been
1-33 made during a period of 24 months from the date that the
1-34 motor vehicle was removed from public or private property.

2- 1 (b) Any person who violates subsection (a) of this Code
2- 2 section shall be guilty of a misdemeanor."
2- 3 SECTION 2.
2- 4 All laws and parts of laws in conflict with this Act are
2- 5 repealed.
