                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 33 of Title 31 of the Official Code of 
  1- 2  Georgia Annotated, relating to health records, so as to 
  1- 3  provide for rights regarding health records of patients who 
  1- 4  are unemancipated minors; to repeal conflicting laws; and 
  1- 5  for other purposes. 
 
  1- 6       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 7                           SECTION 1. 
 
  1- 8  Chapter 33 of Title 31 of the Official Code of Georgia 
  1- 9  Annotated, relating to health records, is amended by adding 
  1-10  at the end a new Code section to read as follows: 
 
  1-11    "31-33-8. 
 
  1-12    A patient who is an unemancipated minor shall not have any 
  1-13    rights under this chapter with respect to records 
  1-14    pertaining to results of tests administered to detect the 
  1-15    use of illegal drugs.  The parent or guardian of such 
  1-16    minor shall have the rights granted a patient under this 
  1-17    chapter with respect to such records when the patient is a 
  1-18    minor child or ward of such parent or guardian, 
  1-19    respectively." 
 
  1-20                           SECTION 2. 
 
  1-21  All laws and parts of laws in conflict with this Act are
