                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 7 of Chapter 4 of Title 49 of the Official 
  1- 2  Code of Georgia Annotated, the "Georgia Medical Assistance 
  1- 3  Act of 1977," so as to provide for the payment of certain 
  1- 4  hospital emergency claims; to provide for an effective date; 
  1- 5  to repeal conflicting laws; and for other purposes. 
 
  1- 6       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 7                           SECTION 1. 
 
  1- 8  Article 7 of Chapter 4 of Title 49 of the Official Code of 
  1- 9  Georgia Annotated, the "Georgia Medical Assistance Act of 
  1-10  1977," is amended by adding immediately following Code 
  1-11  Section 49-4-145, a new Code Section 49-4-145.1 to read as 
  1-12  follows: 
 
  1-13    "49-4-145.1. 
 
  1-14    Claims for recipients who have an emergency condition who 
  1-15    present at a hospital shall be paid by the department 
  1-16    using its standard hospital outpatient reimbursement 
  1-17    methodology for covered services, regardless of the 
  1-18    recipient's final medical diagnosis.  For the purposes of 
  1-19    this Code section, 'emergency condition' shall have the 
  1-20    same meaning as prescribed in paragraph (1) of Code 
  1-21    Section 31-11-81." 
 
  1-22                           SECTION 2. 
 
  1-23  This Act shall become effective upon its approval by the 
  1-24  Governor or upon its becoming law without such approval. 
 
  1-25                           SECTION 3. 
 
  1-26  All laws and parts of laws in conflict with this Act are 
  1-27  repealed.
