                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 50-7-3 of the Official Code of Georgia 
  1- 2  Annotated, relating to the creation of the Board of 
  1- 3  Industry, Trade, and Tourism and the composition of such 
  1- 4  board, so as to reconstitute such board and to add four 
  1- 5  additional board members; to change provisions relating to 
  1- 6  powers of the board; to provide that the board may authorize 
  1- 7  certain intergovernmental agreements and contracts for the 
  1- 8  public purposes of development of trade, commerce, industry, 
  1- 9  and employment opportunities; to provide for the purpose, 
  1-10  scope, and manner of entering into such agreements and 
  1-11  contracts; to provide for related matters; to provide an 
  1-12  effective date; to repeal conflicting laws; and for other 
  1-13  purposes. 
 
  1-14       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-15                           SECTION 1. 
 
  1-16  Code Section 50-7-3 of the Official Code of Georgia 
  1-17  Annotated, relating to the creation of the Board of 
  1-18  Industry, Trade, and Tourism and the composition of such 
  1-19  board, is amended by striking said Code Section in its 
  1-20  entirety and inserting in lieu thereof the following: 
 
  1-21    "50-7-3. 
 
  1-22    (a) The department shall be under the direction and 
  1-23    supervision of a Board of Industry, Trade, and Tourism. 
 
  1-24    (b) On and after July 1, 1983 1999, the Board of Industry, 
  1-25    Trade, and Tourism shall consist of one member from each 
  1-26    congressional district in the state and five nine 
  1-27    additional members from the state at large.  All members 
  1-28    shall be appointed by the Governor, subject to 
  1-29    confirmation by the Senate. The initial terms of members 
  1-30    shall be as follows: two members representative of 
  1-31    congressional districts and one two at-large member 
  1-32    members shall be appointed for a term ending July 1, 1984 
  1-33    2000; two members representative of congressional 
  1-34    districts and one at-large member members shall be

  2- 1    appointed for a term ending July 1, 1985 2001; two three 
  2- 2    members representative of congressional districts and one 
  2- 3    at-large member shall be appointed for a term ending July 
  2- 4    1, 1986 2002; two members representative of congressional 
  2- 5    districts and one two at-large member members shall be 
  2- 6    appointed for a term ending July 1, 1987 2003; and two 
  2- 7    members representative of congressional districts and one 
  2- 8    two at-large member members shall be appointed for a term 
  2- 9    ending July 1, 1988 2004. Thereafter, all members 
  2-10    appointed to the board by the Governor shall be appointed 
  2-11    for terms of five years and until their successors are 
  2-12    appointed and qualified.  In the event of a vacancy during 
  2-13    the term of any member by reason of death, resignation, or 
  2-14    otherwise, the appointment of a successor by the Governor 
  2-15    shall be for the remainder of the unexpired term of such 
  2-16    member. 
 
  2-17    (c) The first members appointed under this Code section 
  2-18    shall be appointed for terms which begin July 1, 1983 
  2-19    1999.  The members of the Board of Industry, Trade, and 
  2-20    Tourism serving on April 1, 1983 1999, shall remain in 
  2-21    office until their successors are appointed and qualified. 
 
  2-22    (d) In addition to all other powers granted to the Board 
  2-23    of Industry, Trade, and Tourism under this chapter, the 
  2-24    board may authorize the Department of Industry, Trade, and 
  2-25    Tourism to enter into and carry out intergovernmental 
  2-26    contracts and agreements for the purpose of providing 
  2-27    financial and other assistance in carrying out projects or 
  2-28    undertakings which will further the public purposes of 
  2-29    development of trade, commerce, industry, and employment 
  2-30    opportunities at the state and local levels. The board may 
  2-31    authorize such contracts and agreements between the 
  2-32    department and other departments, agencies, and entities 
  2-33    of state government and may also authorize such contracts 
  2-34    and agreements between the department and local 
  2-35    development authorities.  Any such contracts and 
  2-36    agreements shall be awarded pursuant to criteria and 
  2-37    procedures developed by the board. Such criteria and 
  2-38    procedures shall be designed to effectuate those proposed 
  2-39    contracts and agreements which will be most effective in 
  2-40    furthering the public purpose of development of trade, 
  2-41    commerce, industry, and employment opportunities at the 
  2-42    state and local levels.  Neither the development of such 
  2-43    criteria nor the award of such contracts and agreements 
  2-44    shall be subject to Chapter 5 of Title 50; Chapter 13 of 
  2-45    Title 50; or Article 5 of Chapter 5 of Title 28.  The

  3- 1    board and the department may expend funds appropriated or 
  3- 2    otherwise available to the board and the department for 
  3- 3    the public purposes described in this subsection." 
 
  3- 4                           SECTION 2. 
 
  3- 5  This Act shall become effective on May 1, 1999. 
 
  3- 6                           SECTION 3. 
 
  3- 7  All laws and parts of laws in conflict with this Act are
