A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 47-2-111 of the Official Code of
1- 2 Georgia Annotated, relating to retirement allowance for
1- 3 certain members of the Employees' Retirement System of
1- 4 Georgia, so as to provide for a retirement age for sworn
1- 5 peace officers employed by the Georgia Public Safety
1- 6 Training Center and the Georgia Emergency Management Agency;
1- 7 to provide conditions for an effective date and automatic
1- 8 repeal; to repeal conflicting laws; and for other purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-10 SECTION 1.
1-11 Code Section 47-2-111 of the Official Code of Georgia
1-12 Annotated, relating to retirement allowance for certain
1-13 members of the Employees' Retirement System of Georgia, is
1-14 amended by striking in its entirety subsection (b) and
1-15 inserting in lieu thereof the following:
1-16 "(b) Any other provision of this chapter to the contrary
1-17 notwithstanding, any member employed by the Uniform
1-18 Division of the Department of Public Safety as an officer,
1-19 a noncommissioned officer, or a trooper; by the Georgia
1-20 Bureau of Investigation as an officer or agent; by the
1-21 Department of Natural Resources as a conservation ranger;
1-22 or by the Department of Revenue as an alcohol and tobacco
1-23 officer or agent or as an officer or agent of the Special
1-24 Investigations Unit; or by the Georgia Public Safety
1-25 Training Center or the Georgia Emergency Management Agency
1-26 if such member is a sworn peace officer certified in
1-27 accordance with the provisions of Chapter 8 of Title 35,
1-28 the 'Georgia Peace Officer Standards and Training Act,'
1-29 shall be eligible to retire at age 55 if he or she has the
1-30 minimum number of years of creditable service provided in
1-31 Code Section 47-2-110, and upon retirement such member
1-32 shall be paid not less than the service retirement
1-33 allowance which would have been payable to such member
1-34 upon service retirement at age 65 without a change in
1-35 compensation and with the same number of years' creditable

2- 1 service to which such member is entitled at the time of
2- 2 retirement."
2- 3 SECTION 2.
2- 4 This Act shall become effective on July 1, 2000, only if it
2- 5 is determined to have been concurrently funded as provided
2- 6 in Chapter 20 of Title 47 of the Official Code of Georgia
2- 7 Annotated, the "Public Retirement Systems Standards Law";
2- 8 otherwise, this Act shall not become effective and shall be
2- 9 automatically repealed in its entirety on July 1, 2000, as
2-10 required by subsection (a) of Code Section 47-20-50.
2-11 SECTION 3.
2-12 All laws and parts of laws in conflict with this Act are
2-13 repealed.
