                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 33-1-9 of the Official Code of Georgia 
  1- 2  Annotated, relating to insurance fraud, so as to provide for 
  1- 3  increased penalties for felony insurance fraud committed 
  1- 4  against persons 60 years of age or older; to provide an 
  1- 5  effective date; to provide for applicability; to repeal 
  1- 6  conflicting laws; and for other purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Code Section 33-1-9 of the Official Code of Georgia 
  1-10  Annotated, relating to insurance fraud, is amended by 
  1-11  striking subsection (c) and inserting in lieu thereof the 
  1-12  following: 
 
  1-13      "(c)(1) A person convicted of a violation of subsection 
  1-14      (a) of this Code section shall be guilty of a felony 
  1-15      and, except as provided in paragraph (2) of this 
  1-16      subsection, shall be punished by imprisonment for not 
  1-17      less than two nor more than ten years, or by a fine of 
  1-18      not more than $10,000.00, or both. 
 
  1-19      (2) A person convicted of a violation of subsection (a) 
  1-20      of this Code section against a person 60 years of age or 
  1-21      older shall be punished by imprisonment for not less 
  1-22      than two nor more than ten years, by a fine of not less 
  1-23      than $5,000.00 nor more than $15,000.00, or both." 
 
  1-24                           SECTION 2. 
 
  1-25  This Act shall become effective on July 1, 1999, and shall 
  1-26  apply with respect to offenses committed on or after that 
  1-27  date.  This Act shall not apply to or affect conduct or 
  1-28  offenses committed prior to that effective date. 
 
  1-29                           SECTION 3. 
 
  1-30  All laws and parts of laws in conflict with this Act are 
  1-31  repealed.
