A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 12-5-135 of the Official Code of
1- 2 Georgia Annotated, relating to requirement of bond or letter
1- 3 of credit from a water well contractor or driller, so as to
1- 4 provide that the bond or irrevocable letter of credit
1- 5 required by law shall have state-wide application; to
1- 6 provide that upon delivery of the prescribed bond or
1- 7 irrevocable letter of credit to the director of the
1- 8 Environmental Protection Division of the Department of
1- 9 Natural Resources no other bond or irrevocable letter of
1-10 credit shall be required of any water well contractor or
1-11 driller for the purposes of protecting the state or any
1-12 political subdivision of the state or the citizens thereof
1-13 from water well contractors or drillers who fail to meet the
1-14 standards as set out in this Act or for any other like
1-15 purpose required by any department, agency, or
1-16 instrumentality of the state or a political subdivision
1-17 thereof; to prohibit acceptance of any bond or irrevocable
1-18 letter of credit from any water well contractor or driller
1-19 who drills any well or borehole for the purpose of injecting
1-20 any surface water into the floridan aquifer during a
1-21 specified period; to repeal conflicting laws; and for other
1-22 purposes.
1-23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-24 SECTION 1.
1-25 Code Section 12-5-135 of the Official Code of Georgia
1-26 Annotated, relating to requirement of bond or letter of
1-27 credit from a water well contractor or driller, is amended
1-28 by adding at the end thereof the following:
1-29 "(g) The bond or irrevocable letter of credit provided for
1-30 in this Code section shall have state-wide application.
1-31 (h) Upon delivery of the prescribed bond or irrevocable
1-32 letter of credit to the director, no other bond or
1-33 irrevocable letter of credit shall be required of any
1-34 water well contractor or driller for the purposes of

2- 1 protecting the state or any political subdivision of the
2- 2 state or the citizens thereof from water well contractors
2- 3 or drillers who fail to meet the standards as set out in
2- 4 this part or for any other like purpose required by any
2- 5 department, agency, or instrumentality of the state or a
2- 6 political subdivision thereof.
2- 7 (i) No bond or irrevocable letter of credit provided for
2- 8 in this Code section shall be accepted by the director
2- 9 from any water well contractor or driller who shall drill
2-10 any well or borehole for the purpose of injecting any
2-11 surface water into the floridan aquifer in any county
2-12 governed by the Georgia coastal zone management program
2-13 provided by Code Section 12-5-327 after July 1, 1999, and
2-14 before December 31, 2002."
2-15 SECTION 2.
2-16 All laws and parts of laws in conflict with this Act are
2-17 repealed.
