A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 40-6-315 of the Official Code of
1- 2 Georgia Annotated, relating to headgear and eye-protective
1- 3 devices for motorcycle riders, so as to provide that certain
1- 4 violations shall not be criminal acts, ordinance violations,
1- 5 or moving traffic violations; to specify a penalty for
1- 6 certain violations; to repeal conflicting laws; and for
1- 7 other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Code Section 40-6-315 of the Official Code of Georgia
1-11 Annotated, relating to headgear and eye-protective devices
1-12 for motorcycle riders, is amended by adding a new subsection
1-13 (e) to read as follows:
1-14 "(e)(1) A person failing to comply with the requirements
1-15 of this Code section shall not be guilty of any criminal
1-16 act and shall not be guilty of violating any ordinance.
1-17 A violation of this Code section shall not be a moving
1-18 traffic violation for purposes of Code Section 40-5-57.
1-19 (2) A person failing to comply with the requirements of
1-20 this Code section, upon conviction of such offense, may
1-21 be fined not more than $15.00; but, the provisions of
1-22 Chapter 11 of Title 17 and any other provision of law to
1-23 the contrary notwithstanding, the costs of such
1-24 prosecution shall not be taxed nor shall any additional
1-25 penalty, fee, or surcharge to a fine for such offense be
1-26 assessed against a person for conviction thereof. The
1-27 court imposing such fine shall forward a record of the
1-28 disposition of the case to the Department of Public
1-29 Safety."
1-30 SECTION 2.
1-31 All laws and parts of laws in conflict with this Act are
1-32 repealed.
