A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 1 of Chapter 16 of Title 15 of the Official
1- 2 Code of Georgia Annotated, relating to general provisions
1- 3 applicable to sheriffs, so as to provide that a sheriff or
1- 4 employee of such officer shall be authorized to store for
1- 5 computer retrieval any or all records, dockets, books,
1- 6 indices, or files and to combine or consolidate any records,
1- 7 dockets, books, indices, or files in connection with the
1- 8 maintenance of any records required by law, provided that
1- 9 any automated or computerized record-keeping method or
1-10 system shall provide for the systematic and safe
1-11 preservation and retrieval of all such records, dockets,
1-12 books, indices, or files; to provide that when a sheriff or
1-13 employee of such officer elects to store for computer
1-14 retrieval any or all records, the same data elements used in
1-15 a manual system shall be used, and the same integrity and
1-16 security maintained; to provide that records which the
1-17 sheriff is required to keep and which are computerized shall
1-18 be maintained and stored for computer retrieval in the
1-19 office of sheriff; to repeal conflicting laws; and for other
1-20 purposes.
1-21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-22 SECTION 1.
1-23 Article 1 of Chapter 16 of Title 15 of the Official Code of
1-24 Georgia Annotated, relating to general provisions applicable
1-25 to sheriffs, is amended by adding at the end of Code Section
1-26 15-16-10, relating to duties of the sheriff and penalties
1-27 for the failure of a sheriff to carry out any such duties, a
1-28 new subsection (d) to read as follows:
1-29 "(d) Nothing in this Code section shall restrict or
1-30 otherwise prohibit a sheriff or a deputy sheriff or clerk
1-31 acting under the authority of a sheriff from electing to
1-32 store for computer retrieval any or all records, dockets,
1-33 books, indices, or files; nor shall a sheriff or a deputy
1-34 sheriff or clerk acting under the authority of a sheriff
1-35 be prohibited from combining or consolidating any records,

2- 1 dockets, books, indices, or files in connection with the
2- 2 maintenance of any records of the kind specified or
2- 3 required in this Code section or any other law, provided
2- 4 that any automated or computerized record-keeping method
2- 5 or system shall provide for the systematic and safe
2- 6 preservation and retrieval of all such records, dockets,
2- 7 books, indices, or files. When the sheriff or a deputy
2- 8 sheriff or clerk acting under the authority of the sheriff
2- 9 elects to store for computer retrieval any or all records,
2-10 the same data elements used in a manual system shall be
2-11 used, and the same integrity and security maintained."
2-12 SECTION 2.
2-13 Said article is further amended by striking in its entirety
2-14 Code Section 15-16-11, relating to the disposition of books
2-15 which the sheriff is required to keep, and inserting in lieu
2-16 thereof a new Code Section 15-16-11 to read as follows:
2-17 "15-16-11.
2-18 All books which the sheriff is required to keep, after
2-19 becoming full, must be deposited in the office of the
2-20 clerk of the superior court to be kept as are other books
2-21 of record; provided, however, that records which the
2-22 sheriff is required to keep and which are computerized
2-23 shall be maintained and stored for computer retrieval in
2-24 the office of sheriff."
2-25 SECTION 3.
2-26 All laws and parts of laws in conflict with this Act are
2-27 repealed.
