                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 9 of Title 50 of the Official Code of 
  1- 2  Georgia Annotated, relating to the Georgia Building 
  1- 3  Authority, so as to require each state entity to submit an 
  1- 4  inventory of state buildings under its control or custody to 
  1- 5  the Georgia Building Authority; to provide for submission of 
  1- 6  such inventory to certain committees of the General 
  1- 7  Assembly; to provide for definitions; to provide for certain 
  1- 8  minimum provisions to be included in such inventory; to 
  1- 9  provide for other related matters; to repeal conflicting 
  1-10  laws; and for other purposes. 
 
  1-11       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-12                           SECTION 1. 
 
  1-13  Chapter 9 of Title 50 of the Official Code of Georgia 
  1-14  Annotated, relating to the Georgia Building Authority, is 
  1-15  amended by adding at the end thereof a new Article 6 to read 
  1-16  as follows: 
 
 
 
  1-17    50-9-110. 
 
  1-18    As used in this article, the term: 
 
  1-19      (1) 'Authority' means the Georgia Building Authority. 
 
  1-20      (2) 'State' means the State of Georgia and any of its 
  1-21      offices, agencies, authorities, departments, 
  1-22      commissions, boards, divisions, instrumentalities, and 
  1-23      institutions but does not include counties, 
  1-24      municipalities, school districts, other units of local 
  1-25      government, hospital authorities, or housing and other 
  1-26      local authorities. 
 
  1-27      (3) 'State building' means a building owned by the state 
  1-28      or under the custody or control of the state or insured 
  1-29      by the program of self-insurance established under Code 
  1-30      Sections 50-16-8 through 50-16-11.

  2- 1      (4) 'State entity' means either of the entities listed 
  2- 2      in paragraph (2) of this subsection. 
 
  2- 3    50-9-111. 
 
  2- 4    (a) Beginning July 1, 1999, each state entity shall 
  2- 5    compile information on all state buildings under the 
  2- 6    custody or control of such state entity necessary for the 
  2- 7    compilation of an inventory of all state-owned or leased 
  2- 8    buildings; provided, however, that all improvements 
  2- 9    acquired for public works that will ultimately be disposed 
  2-10    of are excluded from the requirements of this article.  On 
  2-11    or before October 1, 1999, and as changes occur, but by no 
  2-12    later than such date annually, each state entity shall 
  2-13    send such information to the authority. The authority 
  2-14    shall compile the information in an electronic format and 
  2-15    produce a report to the chairperson of the State 
  2-16    Institutions and Property Committee of the Georgia House 
  2-17    of Representatives and to the chairperson of the Finance 
  2-18    and Public Utilities Committee of the Georgia Senate. 
 
  2-19    (b) The inventory shall be accomplished by the completion 
  2-20    of a form for each state building under the custody or 
  2-21    control of such state entity.  The form shall be designed 
  2-22    and promulgated by the authority. 
 
  2-23    (c) The inventory required by subsection (a) of this Code 
  2-24    section shall include, as a minimum, the following: 
 
  2-25      (1) The name of the building or another description 
  2-26      identifying the building; 
 
  2-27      (2) The location of the building; 
 
  2-28      (3) The name of the building manager or, in the case of 
  2-29      a state building which is leased to a tenant who is 
  2-30      responsible for the operation of the building, the 
  2-31      tenant or the tenant's building manager; 
 
  2-32      (4) The square footage of the building; 
 
  2-33      (5) Information as to whether such building is currently 
  2-34      in use by the state entity or is being leased to a 
  2-35      private tenant by such state entity; 
 
  2-36      (6) The nature of the use of the building at the time 
  2-37      inventory is made; 
 
  2-38      (7) Estimation of the building's fair market value or 
  2-39      replacement value at the time inventory is made, and if 
  2-40      the building is leased to a private tenant who is

  3- 1      responsible for the operation of the building, an 
  3- 2      estimation of the fair market value of the building at 
  3- 3      the time the lease agreement was executed; 
 
  3- 4      (8) Information on major building components, such as 
  3- 5      electrical, mechanical, structural, roof, elevators, 
  3- 6      escalators, underground storage tanks, emergency 
  3- 7      generators, boilers, and life safety systems, and their 
  3- 8      estimated expected life; 
 
  3- 9      (9) Information on the age of the building and its 
  3-10      historic significance, if any; 
 
  3-11      (10) Information on the accessibility of the building 
  3-12      and grounds; 
 
  3-13      (11) Information on energy consumption and utility 
  3-14      connections and usage; and 
 
  3-15      (12) Other information required by the authority, the 
  3-16      chairperson of the State Institutions and Property 
  3-17      Committee of the Georgia House of Representatives, or 
  3-18      the chairperson of the Finance and Public Utilities 
  3-19      Committee of the Georgia Senate." 
 
  3-20                           SECTION 2. 
 
  3-21  All laws and parts of laws in conflict with this Act are
