                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 2 of Chapter 34 of Title 43 of the Official 
  1- 2  Code of Georgia Annotated, relating to physicians, so as to 
  1- 3  provide for the regulation of certain ambulatory surgical 
  1- 4  treatment centers by the Composite State Board of Medical 
  1- 5  Examiners; to repeal conflicting laws; and for other 
  1- 6  purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Article 2 of Chapter 34 of Title 43 of the Official Code of 
  1-10  Georgia Annotated, relating to physicians, is amended by 
  1-11  adding after Code Section 43-34-42.1 a new Code section to 
  1-12  read as follows: 
 
  1-13    "43-34-42.2. 
 
  1-14    (a) As used in this Code section, the term 'ambulatory 
  1-15    surgical treatment center' means any physician's office or 
  1-16    any office, building, or facility attached or adjacent to 
  1-17    the physician's office which is owned by the physician's 
  1-18    practice and which is devoted primarily to the provision 
  1-19    of surgical treatment to patients who do not require 
  1-20    hospitalization.  Such term shall not include any entity 
  1-21    where patients are admitted for treatment that normally 
  1-22    requires an overnight stay, any entity that provides 
  1-23    accommodations for treatment of patients for periods of 24 
  1-24    hours or longer, or any ambulatory surgical treatment 
  1-25    center required to have a permit under Code Section 
  1-26    31-7-3. 
 
  1-27    (b) The board shall be authorized to require an ambulatory 
  1-28    surgical treatment center to meet certain requirements 
  1-29    deemed by the board to be essential for the protection of 
  1-30    patients who undergo medical procedures under general 
  1-31    anesthesia in such centers.  Any such ambulatory surgical 
  1-32    treatment center that has been accredited by a national 
  1-33    accreditation entity, such as, but not limited to, the 
  1-34    American Association for Accreditation of Ambulatory

  2- 1    Surgical Facilities, the Accreditation Association for 
  2- 2    Ambulatory Health Care, the Joint Commission for 
  2- 3    Accreditation of Health Care Facilities, or the American 
  2- 4    Society of Plastic Surgeons, shall be deemed to have met 
  2- 5    the board requirements under this Code section." 
 
  2- 6                           SECTION 2. 
 
  2- 7  All laws and parts of laws in conflict with this Act are
