A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 7 of Title 31 of the Official Code of
1- 2 Georgia Annotated, relating to health care facilities, so as
1- 3 to exempt the purchase, sale, or lease of certain hospitals
1- 4 having fewer than 100 beds from certain restrictions
1- 5 relating to those transactions; to repeal conflicting laws;
1- 6 and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 8 SECTION 1.
1- 9 Chapter 7 of Title 31 of the Official Code of Georgia
1-10 Annotated, relating to health care facilities, is amended by
1-11 adding at the end of Code Section 31-7-89.1, relating to
1-12 sale or lease of hospital authority owned hospitals, a new
1-13 subsection to read as follows:
1-14 "(e) Notwithstanding the provisions of subsection (b) of
1-15 this Code section, the sale or lease of assets of a
1-16 hospital having fewer than 100 beds shall not be subject
1-17 to Article 15 of this chapter."
1-18 SECTION 2.
1-19 Said chapter is further amended by adding after Code Section
1-20 31-7-401, relating to notice of acquisitions of certain
1-21 nonprofit hospitals, the following:
1-22 "31-7-401.1.
1-23 Notwithstanding the other provisions of this article, the
1-24 purchase, lease, or sale of the assets of a hospital
1-25 having fewer than 100 beds shall not be an acquisition or
1-26 disposition subject to this article."
1-27 SECTION 3.
1-28 All laws and parts of laws in conflict with this Act are
1-29 repealed.
