                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 12-5-31 of the Official Code of 
  1- 2  Georgia Annotated, relating to permits for the withdrawal, 
  1- 3  diversion, or impoundment of surface water, so as to 
  1- 4  prohibit aquifer storage or recovery; to provide for a 
  1- 5  definition; to repeal conflicting laws; and for other 
  1- 6  purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Code Section 12-5-31 of the Official Code of Georgia 
  1-10  Annotated, relating to permits for the withdrawal, 
  1-11  diversion, or impoundment of surface water, is amended by 
  1-12  inserting at the end thereof the following: 
 
  1-13    "(p) The director shall not accept, process, or grant any 
  1-14    application for a permit for surface-water withdrawal, 
  1-15    diversion, or impoundment for any applicant who uses or 
  1-16    proposes to use aquifer storage or recovery.  No water 
  1-17    withdrawn pursuant to a permit obtained under this Code 
  1-18    section shall be diverted, recharged, or otherwise placed 
  1-19    into any aquifer.  For the purposes of this subsection, 
  1-20    the term 'aquifer' shall have the meaning set out in Code 
  1-21    Section 12-5-92." 
 
  1-22                           SECTION 2. 
 
  1-23  All laws and parts of laws in conflict with this Act are
