A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 6 of Chapter 4 of Title 49 of the Official
1- 2 Code of Georgia Annotated, "The Medical Assistance for the
1- 3 Aged Act," so as to provide that medicare recipients who are
1- 4 also, by income level, eligible for assistance under such
1- 5 article receive 100 percent reimbursement for prescription
1- 6 drugs; to provide for federal waiver; to repeal conflicting
1- 7 laws; and for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Article 6 of Chapter 4 of Title 49 of the Official Code of
1-11 Georgia Annotated, "The Medical Assistance for the Aged
1-12 Act," is amended by inserting a new Code Section 49-4-122.1
1-13 to read as follows:
1-14 "49-4-122.1.
1-15 Notwithstanding any other provision of law, all persons
1-16 who are eligible for medicare assistance under federal law
1-17 and who are also, by virtue of their income, eligible for
1-18 assistance under this article shall be entitled to receive
1-19 reimbursement under the assistance provisions of this
1-20 article of 100 percent of the cost of any prescription
1-21 drugs which cost is not covered by medicare."
1-22 SECTION 2.
1-23 The Department of Human Resources shall request a waiver
1-24 from the secretary of the federal Department of Health and
1-25 Human Services to permit the Department of Human Resources
1-26 to implement the requirements of this Act. The provisions
1-27 of this Act shall not apply unless the federal waiver is in
1-28 effect. If a waiver is received, the Department of Human
1-29 Resources shall implement this Act.
1-30 SECTION 3.
1-31 All laws and parts of laws in conflict with this Act are
1-32 repealed.
