A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Title 16 of the Official Code of Georgia Annotated,
1- 2 relating to crimes and offenses, so as to change certain
1- 3 definitions relating to use of force in the defense of
1- 4 habitations and property; to repeal conflicting laws; and
1- 5 for other purposes.
1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 7 SECTION 1.
1- 8 Title 16 of the Official Code of Georgia Annotated, relating
1- 9 to crimes and offenses, is amended by striking in its
1-10 entirety Code Section 16-3-24.1, relating to habitation and
1-11 personal property defined, and inserting in lieu thereof a
1-12 new Code Section 16-3-24.1 to read as follows:
1-13 "16-3-24.1.
1-14 As used in Code Sections 16-3-23 and 16-3-24, the term
1-15 'habitation' means any dwelling, motor vehicle, or place
1-16 of business, or property owned, leased, or under the legal
1-17 control of a person using force in its defense, and
1-18 'personal property' means personal property other than a
1-19 motor vehicle."
1-20 SECTION 2.
1-21 All laws and parts of laws in conflict with this Act are
1-22 repealed.
