                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 17-6-71 of the Official Code of 
  1- 2  Georgia Annotated, relating to forfeiture of bail bonds, so 
  1- 3  as to provide for suspension of certain bondspersons who 
  1- 4  fail to satisfy a bond forfeiture judgment; to provide for 
  1- 5  reinstatement; to provide that a bondsperson who is 
  1- 6  suspended is ineligible to act as a commercial surety in 
  1- 7  other counties or municipalities; to repeal conflicting 
  1- 8  laws; and for other purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Code Section 17-6-71 of the Official Code of Georgia 
  1-12  Annotated, relating to forfeiture of bail bonds, is amended 
  1-13  by inserting new subsections, to be designated subsections 
  1-14  (c), (d), and (e), to read as follows: 
 
  1-15    "(c) Any professional bondsperson or person acting as a 
  1-16    surety on an appearance bail bond who fails to satisfy any 
  1-17    bond forfeiture judgment absolute entered by a court of 
  1-18    competent jurisdiction within 120 days after issuance of 
  1-19    such bond forfeiture judgment absolute shall be suspended 
  1-20    by the sheriff regulating such bondsperson's authority to 
  1-21    act as a commercial surety on appearance bail bonds.  This 
  1-22    provision shall apply to any bond forfeiture judgment 
  1-23    absolute entered by any superior court, state court, 
  1-24    probate court, magistrate court, or municipal court. 
 
  1-25    (d) The sheriff regulating commercial bail bondspersons 
  1-26    may reinstate such suspended professional bail 
  1-27    bondsperson's authority to act as a commercial surety on 
  1-28    an appearance bail bond upon proof of satisfaction of any 
  1-29    unpaid bond forfeiture judgments. 
 
  1-30    (e) Any professional bondsperson who is suspended from 
  1-31    acting as surety on an appearance bail bond pursuant to 
  1-32    the provisions of subsection (c) of this Code section 
  1-33    shall also be ineligible to engage in the professional 
  1-34    bail bonding business or act as a commercial surety in any

  2- 1    other county or municipality within this state while under 
  2- 2    such suspension." 
 
  2- 3                           SECTION 2. 
 
  2- 4  All laws and parts of laws in conflict with this Act are
