HB 889 LC 16 4190 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Title 31 of the Official Code of Georgia Annotated, 1- 2 relating to health, so as to provide that hospitals having 1- 3 more than a certain number of beds shall be exempt from the 1- 4 requirement of obtaining a certificate of need in order to 1- 5 offer home health care services; to provide for related 1- 6 matters; to repeal conflicting laws; and for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Title 31 of the Official Code of Georgia Annotated, relating 1- 9 to health, is amended by striking the word "and" at the end 1-10 of paragraph (15) of subsection (a) of Code Section 31-6-47, 1-11 relating to exemptions from the certificate of need program, 1-12 and by striking the period at the end of paragraph (16) and 1-13 inserting in lieu thereof "; and" and by adding a new 1-14 paragraph (17) to read as follows: 1-15 "(17) Expenditures by a hospital with more than 250 beds 1-16 for the purpose of providing the services of a home 1-17 health agency to patients of such hospital after 1-18 discharge from such hospital." SECTION 2. 1-19 Said title is further amended by adding at the end of Code 1-20 Section 31-7-155, relating to certificates of need for new 1-21 service or extending service by a home health agency, to 1-22 read as follows: 1-23 "(d) Notwithstanding any other provision, no home health 1-24 agency operated by a hospital in this state with more than 1-25 250 beds shall be required to obtain a certificate of need 1-26 to continue such operation or to expand its service area." SECTION 3. 1-27 All laws and parts of laws in conflict with this Act are 1-28 repealed. -1- (Index)
