A BILL TO BE ENTITLED
1- 1 To amend Code Section 16-12-171 of the Official Code of
1- 2 Georgia Annotated, relating to prohibited acts regarding the
1- 3 sale of or distribution to minors of cigarettes and tobacco
1- 4 related objects, so as to make it unlawful for any minor to
1- 5 possess or attempt to purchase any cigarettes or tobacco
1- 6 related objects; to provide for misdemeanor criminal
1- 7 penalties for a minor who possesses, purchases, or attempts
1- 8 to purchase cigarettes or tobacco related objects or
1- 9 misrepresents his or her age or identity; to provide for
1-10 exceptions; to provide for a short title; to provide for an
1-11 effective date and applicability; to repeal conflicting
1-12 laws; and for other purposes.
1-13 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-14 SECTION 1.
1-15 This Act shall be known and may be cited as the "Georgia
1-16 Teen Smoking Act."
1-17 SECTION 2.
1-18 Code Section 16-12-171 of the Official Code of Georgia
1-19 Annotated, relating to prohibited acts regarding the sale of
1-20 or distribution to minors of cigarettes and tobacco related
1-21 objects, is amended by striking in its entirety subsection
1-22 (b) and inserting in lieu thereof a new subsection (b) to
1-23 read as follows:
1-24 "(b)(1) It shall be unlawful for any minor knowingly to:
1-25 (A) Purchase or attempt to purchase any cigarettes or
1-26 tobacco related objects;
1-27 (B) Misrepresent such minor's identity or age or use
1-28 any false identification for the purpose of purchasing
1-29 or procuring any cigarettes or tobacco related
1-30 objects; or
1-31 (C) Possess any cigarettes or tobacco related objects.
2- 1 (2) A minor who commits an offense provided for in
2- 2 violates paragraph (1) of this subsection shall be
2- 3 guilty of a misdemeanor and may be punished as follows:
2- 4 (A) By requiring the performance of community service
2- 5 not exceeding 20 hours;
2- 6 (B) By requiring attendance at a publicly or privately
2- 7 sponsored lecture or discussion on the health hazards
2- 8 of smoking or tobacco use, provided such lecture or
2- 9 discussion is offered without charge to the minor; or
2-10 (C) By a fine not to exceed $100.00; or
2-11 (D) By a combination of the punishments described in
2-12 subparagraphs (A) and (B) through (C) of this
2-14 (3) This subsection shall not prohibit minors who are
2-15 employed in supermarkets, convenience stores,
2-16 drugstores, or similar establishments from selling or
2-17 handling cigarettes or tobacco related objects in the
2-18 ordinary course of business of such establishments.
2-19 (4) This subsection shall not apply to minors who are
2-20 acting under the direction of law enforcement officers
2-21 to enforce the provisions of this Code section."
2-22 SECTION 3.
2-23 This Act shall become effective on July 1, 1999, and shall
2-24 apply to offenses committed on and after that date.
2-25 SECTION 4.
2-26 All laws and parts of laws in conflict with this Act are
