A BILL TO BE ENTITLED
1- 1 To amend Code Section 43-34-103 of the Official Code of
1- 2 Georgia Annotated, relating to approval of physician's
1- 3 assistants, so as to change the provisions relating to
1- 4 supervision of such assistants; to provide for actions of
1- 5 such assistants with regard to professional samples; to
1- 6 repeal conflicting laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 8 SECTION 1.
1- 9 Code Section 43-34-103 of the Official Code of Georgia
1-10 Annotated, relating to approval of physician's assistants,
1-11 is amended by striking subsection (b) thereof and inserting
1-12 in its place the following:
1-13 "(b) No physician shall
have supervise more than two
1-14 physician's assistants licensed to him or her at any one
1-15 time. However, a physician may supervise more than two
1-16 physician's assistants while on call for a solo
1-17 practitioner or as a member of a group practice setting,
1-18 for example including, but not limited to, clinics,
1-19 hospitals, and other institutions. The physician taking
1-20 call must be approved to supervise the physician's
1-21 assistant of who is usually supervised by the physician
1-22 for whom he or she is taking call."
1-23 SECTION 2.
1-24 Said Code section is further amended by adding after
1-25 subsection (e.1) a new subsection to read as follows:
1-26 "(e.2) A physician's assistant shall be allowed to
1-27 request, receive, and sign for professional samples and
1-28 may distribute professional samples to patients, pursuant
1-29 to authority delegated by the supervising physician of
1-30 that physician's assistant. Delegation of such authority
1-31 shall be contained in the job description required by this
1-32 Code section. As used in this subsection, the term
1-33 'professional samples' means complimentary doses of a drug
2- 1 or medical devices provided by the manufacturer for use in
2- 2 patient care."
2- 3 SECTION 3.
2- 4 All laws and parts of laws in conflict with this Act are
2- 5 repealed.
