A BILL TO BE ENTITLED
1- 1 To amend Chapter 5 of Title 16 of the Official Code of
1- 2 Georgia Annotated, relating to crimes against the person, so
1- 3 as to provide for the punishment of a person convicted of
1- 4 murdering a certified peace officer; to provide for an
1- 5 effective date and applicability; to provide for related
1- 6 matters; to repeal conflicting laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 8 SECTION 1.
1- 9 Chapter 5 of Title 16 of the Official Code of Georgia
1-10 Annotated, relating to crimes against the person, is amended
1-11 by adding a new Code section, to be designated as Code
1-12 Section 16-5-1.1, to read as follows:
1-14 (a) As used in this Code section, the term 'certified
1-15 peace officer' means a peace officer, as defined in Code
1-16 Section 35-8-2, who has been certified by the Georgia
1-17 Peace Officer Standards and Training Council as having met
1-18 the preemployment standards of Code Section 35-8-8 and
1-19 successfully completed the basic training course required
1-20 by Code Section 35-8-9.
1-21 (b) A person convicted of the offense of murder of a
1-22 certified peace officer while engaged in his or her
1-23 official duties shall be punished by death or by
1-24 imprisonment for life without the possibility of parole."
1-25 SECTION 2.
1-26 This Act shall become effective on July 1, 1998, and shall
1-27 apply to acts or offenses committed on and after that date.
1-28 SECTION 3.
1-29 All laws and parts of laws in conflict with this Act are
