                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 45-18-5 of the Official Code of 
  1- 2  Georgia Annotated, relating to the county officers' and 
  1- 3  employees' health plans, so as to amend certain provisions 
  1- 4  relating to election of plans; to provide for related 
  1- 5  matters; to provide an effective date; to repeal conflicting 
  1- 6  laws; and for other purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Code Section 45-18-5 of the Official Code of Georgia 
  1-10  Annotated, relating to the county officers' and employees' 
  1-11  health plans, is amended by striking in its entirety 
  1-12  subsection (b) and inserting in lieu thereof the following: 
 
  1-13    "(b) County If a county does not offer or provide a health 
  1-14    insurance plan, health maintenance organization, or other 
  1-15    health benefits plan for its county officers, then such 
  1-16    county officers, by majority vote, may elect to be 
  1-17    included in a health insurance plan, health maintenance 
  1-18    organization, or other health benefits plan offered or 
  1-19    provided by a county for its county officers or any health 
  1-20    plan or plans established under this article.  The county 
  1-21    commissioners of a county may elect by majority vote to 
  1-22    provide for payment in a uniform manner of any portion, 
  1-23    all, or none of the required premiums or payments due from 
  1-24    the county officers or former county officers who under 
  1-25    this Code section are eligible for inclusion in the health 
  1-26    plan or plans established under this article.  The board 
  1-27    is authorized to contract with the County Officers 
  1-28    Association of Georgia on behalf of the various counties 
  1-29    of this state for the inclusion in any health insurance 
  1-30    plan or plans established under this article of employees, 
  1-31    spouses, and dependents of employees serving in one or 
  1-32    more of the following capacities: probate judge, sheriff, 
  1-33    tax commissioner or tax collector, clerk of the superior 
  1-34    court, full-time or part-time state court judge, 
  1-35    solicitor, or solicitor-general, chief magistrate, or

  2- 1    full-time chairperson of the board of commissioners; and 
  2- 2    employees, spouses, and dependents of employees leaving 
  2- 3    employment on or after December 31, 1996, who have served 
  2- 4    at least 12 years in one or more of the following 
  2- 5    capacities: probate judge, sheriff, tax commissioner or 
  2- 6    tax collector, clerk of the superior court, full-time or 
  2- 7    part-time state court judge, solicitor, or 
  2- 8    solicitor-general, chief magistrate, or full-time 
  2- 9    chairperson of the board of commissioners.  The County 
  2-10    Officers Association of Georgia is authorized to contract 
  2-11    with the board as provided in this Code section.  In the 
  2-12    event that such a contract is entered into, it shall be 
  2-13    the duty of the County Officers Association of Georgia to 
  2-14    collect from the various counties of this state with which 
  2-15    it has contracted under this subsection of this Code 
  2-16    section and remit same to the board such payment as may be 
  2-17    required under any health insurance plan for inclusion in 
  2-18    the health insurance fund.  In addition, it shall be the 
  2-19    duty of the County Officers Association of Georgia to 
  2-20    maintain and remit to the board accurate records of 
  2-21    employee, dependent, and other information required by the 
  2-22    board to administer this Code section." 
 
  2-23                           SECTION 2. 
 
  2-24  This Act shall become effective upon its approval by the 
  2-25  Governor or upon its becoming effective without such 
  2-26  approval. 
 
  2-27                           SECTION 3. 
 
  2-28  All laws and parts of laws in conflict with this Act are
