                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 7 of Chapter 4 of Title 49 of the Official 
  1- 2  Code of Georgia Annotated, the "Georgia Medical Assistance 
  1- 3  Act of 1977," so as to provide for the enrollment and 
  1- 4  reimbursement of licensed clinical social workers for 
  1- 5  certain mental health evaluations and treatment of 
  1- 6  behavioral disorders of nursing home residents under certain 
  1- 7  conditions; to provide an effective date; to repeal 
  1- 8  conflicting laws; and for other purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Article 7 of Chapter 4 of Title 49 of the Official Code of 
  1-12  Georgia Annotated, the "Georgia Medical Assistance Act of 
  1-13  1977," is amended by adding after Code Section 49-4-149.1 a 
  1-14  new Code section to read as follows: 
 
  1-15    "49-4-149.2. 
 
  1-16    The department shall establish a program that will enroll 
  1-17    and reimburse clinical social workers licensed as such 
  1-18    under Chapter 10A of Title 43, the 'Professional 
  1-19    Counselors, Social Workers, and Marriage and Family 
  1-20    Therapists Licensing Law,' for mental health evaluations 
  1-21    and treatment of behavioral disorders of any resident of a 
  1-22    nursing home, except for evaluations or treatment relating 
  1-23    to mental retardation, when ordered by the attending 
  1-24    physician of such resident.  The administrator of such 
  1-25    nursing home, or the administrator's designee, shall 
  1-26    verify that such evaluation or treatment has been provided 
  1-27    to the named patient upon the date claimed on a form 
  1-28    provided by the department.  Nothing in this Code section 
  1-29    shall require such reimbursement if that reimbursement 
  1-30    would violate federal laws or regulations so as to result 
  1-31    in a loss of federal Medicaid funding." 
 
  1-32                           SECTION 2. 
 
  1-33  This Act shall become effective on July 1, 1997.
