               The House Committee on Special Judiciary offers the 
      following substitute to SB 226: 
 
 
 
                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 16-7-26 of the Official Code of 
  1- 2  Georgia Annotated, relating to vandalism to a public place 
  1- 3  of worship, so as to provide a penalty for such offense when 
  1- 4  one or more persons are injured; to provide an effective 
  1- 5  date; to repeal conflicting laws; and for other purposes. 
 
  1- 6       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 7                           SECTION 1. 
 
  1- 8  Code Section 16-7-26 of the Official Code of Georgia 
  1- 9  Annotated, relating to vandalism to a public place of 
  1-10  worship, is amended by striking in its entirety subsection 
  1-11  (b) and inserting in lieu thereof the following: 
 
  1-12    "(b) A Except as provided in subsection (c) of this Code 
  1-13    section, a person convicted of the offense of vandalism to 
  1-14    a public place of worship shall be punished by 
  1-15    imprisonment for not less than one nor more than five 
  1-16    years." 
 
  1-17                           SECTION 2. 
 
  1-18  Said Code section is further amended by inserting a new 
  1-19  subsection (c) to read as follows: 
 
  1-20    "(c) When any person is physically injured in the course 
  1-21    of vandalism to a public place of worship or as a result 
  1-22    of vandalism to a public place of worship, a person 
  1-23    convicted of such vandalism to a public place of worship 
  1-24    shall be punished by imprisonment for not less than three 
  1-25    nor more than five years." 
 
  1-26                           SECTION 3. 
 
  1-27  Notwithstanding the provisions of subsection (b) of Code 
  1-28  Section 1-3-4.1, this Act shall become effective on July 1, 
  1-29  1997.
