                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 9 of Title 43 of the Official Code of 
  1- 2  Georgia Annotated, relating to chiropractors, so as to 
  1- 3  provide for treatment and certain referrals and failure to 
  1- 4  make those referrals; to provide for statutory construction; 
  1- 5  to provide an effective date; to repeal conflicting laws; 
  1- 6  and for other purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Chapter 9 of Title 43 of the Official Code of Georgia 
  1-10  Annotated, relating to chiropractors, is amended by adding 
  1-11  immediately following Code Section 43-9-12 a new Code 
  1-12  section to read as follows: 
 
  1-13    "43-9-12.1. 
 
  1-14    The doctor of chiropractic must bring to the exercise of 
  1-15    that person's profession a reasonable degree of care and 
  1-16    skill, which shall include the determination of the need 
  1-17    for chiropractic care, as defined in paragraph (2) of Code 
  1-18    Section 43-9-1, and shall render treatment, referral to 
  1-19    the appropriate health care provider, or both treatment 
  1-20    and referral commensurate with that chiropractor's 
  1-21    findings.  Any failure to refer to the appropriate health 
  1-22    care provider may subject the doctor of chiropractic to 
  1-23    the provisions of Code Section 43-9-12.  Nothing in this 
  1-24    Code section shall be deemed to expand or limit the 
  1-25    chiropractic scope of practice." 
 
  1-26                           SECTION 2. 
 
  1-27  This Act shall become effective on July 1, 1997. 
 
  1-28                           SECTION 3. 
 
  1-29  All laws and parts of laws in conflict with this Act are 
  1-30  repealed.
