                             A RESOLUTION 
 
  1- 1  Compensating Guy's Automotive; and for other purposes. 
 
  1- 2  WHEREAS, Guy's Automotive, owned by Mr. Jesse Guy and 
  1- 3  located in Waycross, Georgia, holds a valid Georgia title 
  1- 4  with a lien in its favor against a 1990 Plymouth Laser; and 
 
  1- 5  WHEREAS, after having broken down on the side of the road, 
  1- 6  the 1990 Plymouth Laser was towed to Wilson's Towing Company 
  1- 7  in Jacksonville, Florida; and 
 
  1- 8  WHEREAS, upon failure of the owner to retrieve the vehicle, 
  1- 9  Wilson's Towing Company purchased it at court sale; and 
 
  1-10  WHEREAS, no notice of any of the proceedings was ever given 
  1-11  to Guy's Automotive; and 
 
  1-12  WHEREAS, despite the lien held by Guy's Automotive at the 
  1-13  time, Wilson's Towing Company, which followed proper 
  1-14  procedures, obtained a Florida title for the vehicle on 
  1-15  November 14, 1995; and 
 
  1-16  WHEREAS, as the law requires, prior to the issuance of the 
  1-17  Florida title, the Duval County sheriff's department 
  1-18  contacted the Georgia Motor Vehicle Division of the 
  1-19  Department of Revenue and inquired about outstanding liens 
  1-20  against the automobile and was erroneously informed that 
  1-21  none existed; and 
 
  1-22  WHEREAS, as a result of the error by the Georgia Motor 
  1-23  Vehicle Division of the Department of Revenue, Guy's 
  1-24  Automotive has suffered unreimbursed property loss in the 
  1-25  amount of $4,943.98; and 
 
  1-26  WHEREAS, the loss occurred through no fault or negligence on 
  1-27  the part of Guy's Automotive, and it is only fitting and 
  1-28  proper that it be compensated for its loss. 
 
  1-29  NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF 
  1-30  GEORGIA that the Department of Revenue is authorized and 
  1-31  directed to pay the sum of $4,943.98 to Guy's Automotive as 
  1-32  compensation as provided above.  Said sum shall be paid from 
  1-33  funds appropriated to or available to said department and 
  1-34  shall be in full and complete satisfaction of all claims 
  1-35  against the state arising out of said occurrence.
