                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 2 of Chapter 2 of Title 40 of the Official 
  1- 2  Code of Georgia Annotated, relating to registration and 
  1- 3  licensing of motor vehicles generally, so as to change 
  1- 4  certain provisions relating to display of license plates; to 
  1- 5  provide an effective date; to repeal conflicting laws; and 
  1- 6  for other purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Article 2 of Chapter 2 of Title 40, relating to registration 
  1-10  and licensing of motor vehicles generally, is amended by 
  1-11  striking Code Section 40-2-41, relating to display of 
  1-12  license plates, and inserting in its place the following: 
 
  1-13    "40-2-41. 
 
  1-14    Every vehicle required to be registered under this 
  1-15    chapter, which is in use upon the highways, shall at all 
  1-16    times display the license plate assigned to it, and the 
  1-17    plate shall be fastened to the rear of the vehicle in a 
  1-18    position so as not to swing and shall be at all times 
  1-19    plainly visible. No person shall display on the rear of a 
  1-20    motor  vehicle any temporary or permanent plate or tag not 
  1-21    issued by the State of Georgia which is intended to 
  1-22    resemble a license plate which is issued by the State of 
  1-23    Georgia.  The commissioner is authorized to adopt rules 
  1-24    and regulations so as to permit the display of a license 
  1-25    plate on the front of certain vehicles. It shall be the 
  1-26    duty of the operator of any vehicle to keep the license 
  1-27    plate legible at all times. No license plate shall be 
  1-28    covered with any material unless the material is colorless 
  1-29    and transparent. No, and no apparatus that obstructs or 
  1-30    hinders the clear display and legibility of a license 
  1-31    plate shall be attached to the rear of any motor vehicle 
  1-32    required to be registered in the state; except that the 
  1-33    commissioner shall provide by rule or regulation for the 
  1-34    use, upon application by a vehicle owner and approval of

  2- 1    the Department of Revenue, of a license plate cover 
  2- 2    containing a colored or nontransparent image which does 
  2- 3    not obstruct the clear display and legibility of any 
  2- 4    numbers, letters, or symbols made a part of a license 
  2- 5    plate or decal assigned to the vehicle.  Any person who 
  2- 6    violates any provision of this Code section shall be 
  2- 7    guilty of a misdemeanor." 
 
  2- 8                           SECTION 2. 
 
  2- 9  This Act shall become effective on July 1, 1997. 
 
  2-10                           SECTION 3. 
 
  2-11  All laws and parts of laws in conflict with this Act are
