                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 50-18-72 of the Official Code of 
  1- 2  Georgia Annotated, relating to exemptions from public 
  1- 3  disclosure of certain records, so as to add restrictions on 
  1- 4  the disclosure of audit work papers, notes, and draft 
  1- 5  reports until the audit report has been finalized or the 
  1- 6  audit terminated; to provide for related matters; to provide 
  1- 7  an effective date; to repeal conflicting laws; and for other 
  1- 8  purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Code Section 50-18-72 of the Official Code of Georgia 
  1-12  Annotated, relating to exemptions from public disclosure of 
  1-13  certain records, is amended by striking paragraphs (10) and 
  1-14  (11) of subsection (a) of said Code section and inserting in 
  1-15  lieu thereof new paragraphs (10), (11), and (12) to read as 
  1-16  follows: 
 
  1-17      "(10) Records that contain information from the 
  1-18      Department of Natural Resources inventory and register 
  1-19      relating to the location and character of a historic 
  1-20      property or of historic properties as those terms are 
  1-21      defined in Code Sections 12-3-50.1 and 12-3-50.2 if the 
  1-22      Department of Natural Resources through its Division of 
  1-23      Historic Preservation determines that disclosure will 
  1-24      create a substantial risk of harm, theft, or destruction 
  1-25      to the property or properties or the area or place where 
  1-26      the property or properties are located; or 
 
  1-27      (11) Records that contain site specific information 
  1-28      regarding the occurrence of rare species of plants or 
  1-29      animals or the location of sensitive natural habitats on 
  1-30      public or private property if the Department of Natural 
  1-31      Resources determines that disclosure will create a 
  1-32      substantial risk of harm, theft, or destruction to the 
  1-33      species or habitats or the area or place where the 
  1-34      species or habitats are located; provided, however, that

  2- 1      the owner or owners of private property upon which rare 
  2- 2      species of plants or animals occur or upon which 
  2- 3      sensitive natural habitats are located shall be entitled 
  2- 4      to such information pursuant to this article.; or 
 
  2- 5      (12) Audit work papers, audit notes, or draft audit 
  2- 6      reports until such time as the audit report to which 
  2- 7      such records relate has been finalized or the audit to 
  2- 8      which such records relate has been otherwise completed 
  2- 9      or terminated." 
 
  2-10                           SECTION 2. 
 
  2-11  This Act shall become effective upon its approval by the 
  2-12  Governor or upon its becoming law without such approval. 
 
  2-13                           SECTION 3. 
 
  2-14  All laws and parts of laws in conflict with this Act are
