                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend an Act changing the boundaries of the seven 
  1- 2  education districts of the Cobb County School District, 
  1- 3  approved March 28, 1974 (Ga. L. 1974, p. 3516), as amended, 
  1- 4  so as to change the boundaries of the seven education 
  1- 5  districts for the election of members of the Board of 
  1- 6  Education of Cobb County; to provide for definitions and 
  1- 7  inclusions; to require submission of this Act to the United 
  1- 8  States Attorney General for certain approval; to provide an 
  1- 9  effective date; to repeal conflicting laws; and for other 
  1-10  purposes. 
 
  1-11       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-12                           SECTION 1. 
 
  1-13  An Act changing the boundaries of the seven education 
  1-14  districts of the Cobb County School District, approved March 
  1-15  28, 1974 (Ga. L. 1974, p. 3516), as amended, is amended by 
  1-16  striking subsection (a) of Section 2 of said Act and 
  1-17  inserting in lieu thereof a new subsection (a) to read as 
  1-18  follows: 
 
  1-19    "(a) For the purpose of electing members of the Board of 
  1-20    Education of Cobb County, the Cobb County School District 
  1-21    is divided into seven education districts as set forth in 
  1-22    the description attached to this Act and made a part 
  1-23    hereof and further identified as     'Operator: local 
  1-24    Client: cobb   Plan: cobbsb98b.' 
 
  1-25    (b) For purposes of this subsection: 
 
  1-26      (1) The terms 'Tract,' 'Block,' and 'VTD' shall mean and 
  1-27      describe the same geographical boundaries as provided in 
  1-28      the report of the Bureau of the Census for the United 
  1-29      States decennial census of 1990 for the State of 
  1-30      Georgia; 
 
  1-31      (2) The term 'precinct' is synonymous with the term 
  1-32      'voting precinct'  and means a geographical area 
  1-33      designated by Article 7 of Chapter 2 or 3 of Title 21 of

  2- 1      the O.C.G.A., within which all electors vote at one 
  2- 2      polling place; 
 
  2- 3      (3) Precinct names and designations following VTD 
  2- 4      designations are included for convenience only; and in 
  2- 5      the event the description of any education district 
  2- 6      contains a conflict between the geographical boundaries 
  2- 7      of any VTD and the boundaries of the following named 
  2- 8      precinct, the geographical boundary of the VTD as shown 
  2- 9      on the census maps for the United States decennial 
  2-10      census of 1990 for the State of Georgia shall control; 
 
  2-11      (4) Any part of the Cobb County School District which is 
  2-12      not included in any education district described in this 
  2-13      section shall be included within that education district 
  2-14      contiguous to such part which contains the least 
  2-15      population according to the United States decennial 
  2-16      census of 1990  for  the State of Georgia; and 
 
  2-17      (5) Any part of the Cobb County School District which is 
  2-18      described in this section as being included in a 
  2-19      particular education district shall nevertheless not be 
  2-20      included within such education district if such part is 
  2-21      not contiguous to such education district.  Such 
  2-22      noncontiguous part shall instead be included within that 
  2-23      education district contiguous to such part which 
  2-24      contains the least population according to the United 
  2-25      States decennial census of 1990 for the State of 
  2-26      Georgia." 
 
  2-27                           SECTION 2. 
 
  2-28  This Act shall become effective upon its approval by the 
  2-29  Governor or upon its becoming law without such approval. 
  2-30  Pursuant to Section 5 of the federal Voting Rights Act of 
  2-31  1965, as amended, it shall be the duty of the attorney of 
  2-32  the Cobb County Board of Education to submit this Act to the 
  2-33  United States Attorney General for approval. 
 
  2-34                           SECTION 3. 
 
  2-35  All laws and parts of laws in conflict with this Act are 
  2-36  repealed.
