                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend an Act changing the compensation of the clerk of 
  1- 2  the Superior Court, the sheriff, and the judge of the 
  1- 3  Probate Court of Cobb County from the fee system to the 
  1- 4  salary system, approved February 9, 1949 (Ga. L. 1949, p. 
  1- 5  427), as amended, particularly by an Act approved March 20, 
  1- 6  1990 (Ga. L. 1990, p. 4209), an Act approved April 5, 1995 
  1- 7  (Ga. L. 1995, p. 4126), and an Act approved April 4, 1997 
  1- 8  (Ga. L. 1997, p. 3609), so as to change the compensation of 
  1- 9  the deputy clerk of the superior court; to provide an 
  1-10  effective date; to repeal conflicting laws; and for other 
  1-11  purposes. 
 
  1-12       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-13                           SECTION 1. 
 
  1-14  An Act changing the compensation of the clerk of the 
  1-15  Superior Court, the sheriff, and the judge of the Probate 
  1-16  Court of Cobb County from the fee system to the salary 
  1-17  system, approved February 9, 1949 (Ga. L. 1949, p. 427), as 
  1-18  amended, particularly by an Act approved March 20, 1990 (Ga. 
  1-19  L. 1990, p. 4209), an Act approved April 5, 1995 (Ga. L. 
  1-20  1995, p. 4126), and an Act approved April 4, 1997 (Ga. L. 
  1-21  1997, p. 3609), is amended by striking subsection (b) of 
  1-22  Section 4 thereof and inserting in its place a new 
  1-23  subsection (b) to read as follows: 
 
  1-24    "(b) The clerk of the superior court shall be allowed a 
  1-25    deputy clerk whose annual salary shall be $60,374.00, to 
  1-26    be paid in equal monthly installments from the funds in 
  1-27    the county treasury.  Any candidate for the office of 
  1-28    clerk of the Superior Court of Cobb County shall, on the 
  1-29    date of his or her qualification for such office in either 
  1-30    a primary or general election, certify to the judge of the 
  1-31    Probate Court of Cobb County the name of the person he or 
  1-32    she shall appoint as deputy clerk in the event he or she 
  1-33    is elected to the office of clerk; and the person so named 
  1-34    and certified by the successful candidate for such office 
  1-35    shall serve as the deputy clerk during the term for which

  2- 1    he or she was so named.  In the event of the death or 
  2- 2    removal from office of said deputy clerk, the clerk of the 
  2- 3    superior court shall have 30 days from said date of death 
  2- 4    or removal from office of said deputy clerk to certify to 
  2- 5    the judge of the Probate Court of Cobb County the name of 
  2- 6    the new deputy clerk to be appointed.  In addition to said 
  2- 7    deputy clerk, the clerk of the Superior Court of Cobb 
  2- 8    County shall be authorized and empowered to employ the 
  2- 9    clerical help necessary to perform properly the functions 
  2-10    and duties of the office, provided that the number of 
  2-11    employees and salaries or other compensation to be paid to 
  2-12    each shall first be approved by the governing authority of 
  2-13    Cobb County." 
 
  2-14                           SECTION 2. 
 
  2-15  This Act shall become effective on January 1, 1999. 
 
  2-16                           SECTION 3. 
 
  2-17  All laws and parts of laws in conflict with this Act are
