                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend an Act creating the Cobb County-Marietta Water 
  1- 2  Authority, approved February 21, 1951 (Ga. L. 1951, p. 497), 
  1- 3  as amended, particularly by an Act approved March 30, 1989 
  1- 4  (Ga. L. 1989, p. 4711), and an Act approved April 5, 1995 
  1- 5  (Ga. L. 1995, p. 4121), so as to change the membership of 
  1- 6  the authority; to provide for related matters; to repeal 
  1- 7  conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  An Act creating the Cobb County-Marietta Water Authority, 
  1-11  approved February 21, 1951 (Ga. L. 1951, p. 497), as 
  1-12  amended, particularly by an Act approved March 30, 1989 (Ga. 
  1-13  L. 1989, p. 4711), and an Act approved April 5, 1995 (Ga. L. 
  1-14  1995, p. 4121), is amended by striking subsections (b), (c), 
  1-15  and (d) of Section 2 thereof in their entirety and inserting 
  1-16  in lieu thereof the following: 
 
  1-17    "(b) The membership of the authority shall be determined 
  1-18    and selected as follows: 
 
  1-19      (1) One member shall be the chairperson of the Board of 
  1-20      Commissioners of Cobb County, ex officio; 
 
  1-21      (2) The governing authority of each incorporated 
  1-22      municipality located in Cobb County having a population 
  1-23      in excess of 30,000 according to the 1990 decennial 
  1-24      census or any subsequent such census shall each appoint 
  1-25      one member; 
 
  1-26      (3) The governing authority of each incorporated 
  1-27      municipality located in Cobb County having a population 
  1-28      of 30,000 or less according to the 1990 decennial census 
  1-29      or any subsequent such census shall each appoint one 
  1-30      member according to the following schedule: 
 
  1-31        (A)  Within two weeks following the effective date of 
  1-32        this section, the governing authority of any 
  1-33        incorporated municipality having a population in

  2- 1        excess of 30,000 and which is not currently 
  2- 2        represented on the authority shall appoint a member to 
  2- 3        serve until August 14, 2000. The term of office of the 
  2- 4        representative of the of the City of Marietta serving 
  2- 5        on the effective date of this section shall continue 
  2- 6        until August 14, 2000. On August 14, 2000, such 
  2- 7        municipalities shall each appoint a member to serve a 
  2- 8        term of four years; and 
 
  2- 9        (B) The  member appointed by the City of Powder 
  2-10        Springs shall continue until August 14, 2000. 
  2-11        Beginning on August 14, 2000, the member appointed by 
  2-12        the following municipalities shall be a member in turn 
  2-13        for terms of four years to succeed one another in the 
  2-14        following order: Acworth, Austell, Kennesaw, and 
  2-15        Powder Springs; and 
 
  2-16      (4) A caucus consisting of all members of the General 
  2-17      Assembly whose districts are wholly or partially within 
  2-18      Cobb County shall appoint a number of members which 
  2-19      shall exceed by one the number of members provided in 
  2-20      paragraph (2) of this subsection. Such legislative 
  2-21      appointees shall reside in unincorporated Cobb County. 
  2-22      The first members so appointed shall take office on 
  2-23      August 14, 1998, and they and their successors shall 
  2-24      serve terms of four years." 
 
  2-25                           SECTION 2. 
 
  2-26  All laws and parts of laws in conflict with this Act are
