A BILL TO BE ENTITLED
1- 1 To amend Chapter 6 of Title 16 of the Official Code of
1- 2 Georgia Annotated, relating to sexual crimes, so as to
1- 3 provide that the minimum sentence for statutory rape shall
1- 4 not be probated, stayed, or suspended in certain
1- 5 circumstances; to provide an effective date and for
1- 6 applicability; to repeal conflicting laws; and for other
1- 7 purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Chapter 6 of Title 16 of the Official Code of Georgia
1-11 Annotated, relating to sexual crimes, is amended by striking
1-12 in its entirety subsection (b) of Code Section 16-6-3,
1-13 relating to statutory rape, and inserting in its place the
1-15 "(b) A person convicted of the offense of statutory rape
1-16 shall be punished by imprisonment for not less than one
1-17 nor more than 20 years; provided, however, that if the
1-18 person so convicted is 21 years of age or older, such
1-19 person shall be punished by imprisonment for not less than
1-20 ten nor more than 20 years; provided, further, that if the
1-21 victim is 14 or 15 years of age and the person so
1-22 convicted is no more than three years older than the
1-23 victim, such person shall be guilty of a misdemeanor. If
1-24 the person convicted of statutory rape is 21 years of age
1-25 or older and is eight years or more than eight years older
1-26 than the victim, no part of the minimum sentence of ten
1-27 years' imprisonment shall be probated, stayed, or
1-29 SECTION 2.
1-30 This Act shall become effective on July 1, 1998, and shall
1-31 apply to conduct occurring or allegedly occurring on or
1-32 after such date.

2- 2 All laws and parts of laws in conflict with this Act are
2- 3 repealed.
