                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 16-12-1 of the Official Code of 
  1- 2  Georgia Annotated, relating to the offense of contributing 
  1- 3  to the delinquency, unruliness, or deprivation of a minor, 
  1- 4  so as to change certain penalty provisions applicable to 
  1- 5  such offense; to provide an effective date; to repeal 
  1- 6  conflicting laws; and for other purposes. 
 
  1- 7       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 8                           SECTION 1. 
 
  1- 9  Code Section 16-12-1 of the Official Code of Georgia 
  1-10  Annotated, relating to the offense of contributing to the 
  1-11  delinquency, unruliness, or deprivation of a minor, is 
  1-12  amended by striking subsection (d) in its entirety and 
  1-13  inserting in lieu thereof a new subsection (d) to read as 
  1-14  follows: 
 
  1-15    "(d) A person convicted pursuant to paragraph (1) or (2) 
  1-16    of subsection (b) of this Code section shall be punished 
  1-17    as follows: 
 
  1-18      (1) Upon conviction of the first or second offense, the 
  1-19      defendant shall be guilty of a misdemeanor and shall be 
  1-20      fined not less than $200.00 nor more than $500.00 
  1-21      $1,000.00 or shall be imprisoned for not less than one 
  1-22      month nor more than five 12 months, or both fined and 
  1-23      imprisoned; and  
 
  1-24      (2) Upon conviction of the second offense, the defendant 
  1-25      shall be guilty of a misdemeanor and shall be fined not 
  1-26      less than $400.00 nor more than $1,000.00 or shall be 
  1-27      imprisoned for not less than three months nor more than 
  1-28      one year, or both fined and imprisoned; and 
 
  1-29      (3)(2) Upon the conviction of the third or subsequent 
  1-30      offense, the defendant shall be guilty of a felony and 
  1-31      shall be fined not less than $1,000.00 nor more than 
  1-32      $5,000.00 or shall be imprisoned for not less than one

  2- 1      year nor more than three years, or both fined and 
  2- 2      imprisoned." 
 
  2- 3                           SECTION 2. 
 
  2- 4  This Act shall become effective upon its approval by the 
  2- 5  Governor or upon its becoming law without such approval. 
 
  2- 6                           SECTION 3. 
 
  2- 7  All laws and parts of laws in conflict with this Act are
