                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 7 of Title 44 of the Official Code of 
  1- 2  Georgia Annotated, relating to landlords and tenants, so as 
  1- 3  to permit leases for commercial space to include a provision 
  1- 4  accelerating the rent upon default by the tenant; to provide 
  1- 5  a definition; to provide for enforceability of such a 
  1- 6  provision; to repeal conflicting laws; and for other 
  1- 7  purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Chapter 7 of Title 44 of the Official Code of Georgia 
  1-11  Annotated, relating to landlords and tenants, is amended by 
  1-12  inserting a new Code section to be designated Code Section 
  1-13  44-7-22 to read as follows: 
 
  1-14    "44-7-22. 
 
  1-15    (a) As used in this Code section, the term 'commercial' 
  1-16    means: 
 
  1-17      (1) Not used by the tenant as a dwelling; or 
 
  1-18      (2) Not designed or intended to be used as a dwelling 
  1-19      for a single household. 
 
  1-20    (b) Notwithstanding any other law to the contrary, a lease 
  1-21    or rental agreement for commercial space may include a 
  1-22    provision for acceleration of rent due upon default of the 
  1-23    tenant. Such a provision shall be enforceable." 
 
  1-24                           SECTION 2. 
 
  1-25  All laws and parts of laws in conflict with this Act are
