                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend the "Atlanta Urban Enterprise Zone Act," approved 
  1- 2  March 24, 1988 (Ga. L. 1988, p. 4164), as amended, 
  1- 3  particularly by an Act approved March 25, 1996 (Ga. L. 1996, 
  1- 4  p. 3622), so as to change provisions relating to the 
  1- 5  duration of zones created for mixed use residential and 
  1- 6  commercial purposes; to repeal conflicting laws; and for 
  1- 7  other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  The "Atlanta Urban Enterprise Zone Act," approved March 24, 
  1-11  1988 (Ga. L. 1988, p. 4164), as amended, particularly by an 
  1-12  Act approved March 25, 1996 (Ga. L. 1996, p. 3622), is 
  1-13  amended by striking paragraph (2) of subsection (d) of 
  1-14  Section 8 thereof, which reads as follows: 
 
  1-15      "(2) A zone shall exist for ten years after the 
  1-16      effective date of its creation and at the end of this 
  1-17      period the zone and all exemptions established therein 
  1-18      pursuant to this Act shall be abolished.", 
 
  1-19  and inserting in its place the following: 
 
  1-20        "(2)(A) Except as provided in subparagraph (B) of this 
  1-21        paragraph, a zone shall exist for ten years after the 
  1-22        effective date of its creation. 
 
  1-23        (B) If a zone is located within an area designated by 
  1-24        the federal government as an 'empowerment zone,' and 
  1-25        the effective date of the creation of the zone was 
  1-26        January 1, 1996, and the City of Atlanta issued no 
  1-27        certificate of occupancy for any residential or 
  1-28        commercial space in that zone before January 1, 1998, 
  1-29        then such zone shall exist for 12 years after the 
  1-30        effective date of its creation.  At the end of such 12 
  1-31        year period, the zone shall be abolished.  The 
  1-32        schedule of reduction in the exemptions provided for 
  1-33        by paragraph (1) of this subsection shall begin on

  2- 1        January 1, 1998. In no event may property be granted 
  2- 2        the exemption provided under this subparagraph for 
  2- 3        more than ten years." 
 
  2- 4                           SECTION 2. 
 
  2- 5  All laws and parts of laws in conflict with this Act are
