                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 31-6-47 of the Official Code of 
  1- 2  Georgia Annotated, relating to exemptions from certificate 
  1- 3  of need, so as to provide for an additional exemption for 
  1- 4  certain skilled nursing facilities; to repeal conflicting 
  1- 5  laws; and for other purposes. 
 
  1- 6       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 7                           SECTION 1. 
 
  1- 8  Code Section 31-6-47 of the Official Code of Georgia 
  1- 9  Annotated, relating to exemptions from certificate of need, 
  1-10  is amended by adding after paragraph (14) of subsection (a) 
  1-11  the following: 
 
  1-12      "(14.1) New institutional health services which provide 
  1-13      skilled nursing facilities, subject to the following 
  1-14      conditions: 
 
  1-15        (A) No more than ten such facilities may be approved; 
 
  1-16        (B) No such facility shall have a skilled nursing home 
  1-17        bed capacity exceeding 100 beds; 
 
  1-18        (C) Each such facility shall be owned and operated by 
  1-19        a nonprofit corporation; 
 
  1-20        (D) The facility must be part of a continuum of care 
  1-21        which provides at least 20 independent living units, 
  1-22        20 assisted living units, and services through a home 
  1-23        health agency; and 
 
  1-24        (E) Feasibility studies must demonstrate the economic 
  1-25        viability of the entire continuum of care project, 
  1-26        including but not limited to reasonable reserves for 
  1-27        future care needs of all the residents of the 
  1-28        project;". 
 
  1-29                           SECTION 2. 
 
  1-30  All laws and parts of laws in conflict with this Act are 
  1-31  repealed.
