                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 43-34-3 of the Official Code of 
  1- 2  Georgia Annotated, relating to continuing education 
  1- 3  requirements for persons licensed or certified by the 
  1- 4  Composite State Board of Medical Examiners, so as to provide 
  1- 5  for continuing education requirements for respiratory care 
  1- 6  professionals; to provide an effective date; to repeal 
  1- 7  conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Code Section 43-34-3 of the Official Code of Georgia 
  1-11  Annotated, relating to continuing education requirements for 
  1-12  persons licensed or certified by the Composite State Board 
  1-13  of Medical Examiners, is amended by striking subsection (a) 
  1-14  and inserting in lieu thereof a new subsection (a) to read 
  1-15  as follows: 
 
  1-16      "(a)(1) The board shall be authorized to require persons 
  1-17      seeking renewal of a license or certificate under this 
  1-18      chapter to complete  board approved continuing education 
  1-19      of not less than 40 hours biennially. The board shall be 
  1-20      authorized to approve courses offered by institutions of 
  1-21      higher learning, specialty societies, or professional 
  1-22      organizations, including, but not limited to, the 
  1-23      American Medical Association, the National Medical 
  1-24      Association, and the American Osteopathic Association, 
  1-25      the number of hours required, and the category in which 
  1-26      these hours should be earned.  This Code section 
  1-27      paragraph shall not apply to respiratory care 
  1-28      professionals or persons seeking renewal of 
  1-29      certification as respiratory care professionals. 
 
  1-30      (2) The board shall be authorized to require persons 
  1-31      seeking renewal of certification as respiratory care 
  1-32      professionals under Article 6 of this chapter to 
  1-33      complete board approved continuing education. The board 
  1-34      shall be authorized to establish the number of hours of

  2- 1      continuing education required biennally for renewal of 
  2- 2      certification as a respiratory care professional and the 
  2- 3      categories in which these hours should be earned. The 
  2- 4      board shall be authorized to approve courses offered by 
  2- 5      institutions of higher learning, specialty societies, or 
  2- 6      professional organizations. Any action taken by the 
  2- 7      board pursuant to this paragraph shall be taken in 
  2- 8      conformity with the provisions of Code Section 
  2- 9      43-34-143." 
 
  2-10                           SECTION 2. 
 
  2-11  This Act shall become effective July 1, 1997. 
 
  2-12                           SECTION 3. 
 
  2-13  All laws and parts of laws in conflict with this Act are
