                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 4 of Chapter 9 of Title 16 of the Official 
  1- 2  Code of Georgia Annotated, relating to fraud and related 
  1- 3  offenses, so as to prohibit a person, governmental agency, 
  1- 4  or business entity from taking, assuming, or using the 
  1- 5  identity, name, birth date, social security number, alien 
  1- 6  identification number, or identification of another person 
  1- 7  without the consent of that other person and with the intent 
  1- 8  to obtain or use the other person's identity for any 
  1- 9  unlawful purpose or to cause financial loss to the other 
  1-10  person; to provide for penalties; to repeal conflicting 
  1-11  laws; and for other purposes. 
 
  1-12       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-13                           SECTION 1. 
 
  1-14  Article 4 of Chapter 9 of Title 16 of the Official Code of 
  1-15  Georgia Annotated, relating to fraud and related offenses, 
  1-16  is amended by adding at the end thereof a new Code Section 
  1-17  16-9-62 to read as follows: 
 
  1-18    "16-9-62. 
 
  1-19    (a) A person, governmental agency, or business entity 
  1-20    taking, assuming, or using the identity, name, birth date, 
  1-21    social security number, alien identification number, or 
  1-22    identification of another person without the consent of 
  1-23    that other person and with the intent to obtain or use the 
  1-24    other person's identity for any unlawful purpose or to 
  1-25    cause financial loss to the other person commits the 
  1-26    offense of taking the identity of another. 
 
  1-27    (b) A person convicted of the offense of taking the 
  1-28    identity of another shall be punished by a fine of up to 
  1-29    $150,000.00 or by imprisonment for not less than one nor 
  1-30    more than five years, or both." 
 
  1-31                           SECTION 2. 
 
  1-32  All laws and parts of laws in conflict with this Act are 
  1-33  repealed.
