                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 3 of Chapter 5 of Title 12 of the Official 
  1- 2  Code of Georgia Annotated, relating to wells and drinking 
  1- 3  water, so as to require that instructions by county 
  1- 4  personnel for the placement of wells be made in writing; to 
  1- 5  provide for matters related to the foregoing; to provide an 
  1- 6  effective date; to repeal conflicting laws; and for other 
  1- 7  purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Article 3 of Chapter 5 of Title 12 of the Official Code of 
  1-11  Georgia Annotated, relating to wells and drinking water, is 
  1-12  amended by deleting the semicolon at the end of division 
  1-13  (ii) and inserting in lieu thereof a period and adding a new 
  1-14  division (iii) at the end of subparagraph (A) of paragraph 
  1-15  (1) of Code Section 12-5-134, relating to standards for 
  1-16  wells and boreholes, to read as follows: 
 
  1-17          "(iii) Any direction by personnel of a county board 
  1-18          of health or other county personnel requiring the 
  1-19          placement of a water well in a particular location 
  1-20          on a property shall be unenforceable unless such 
  1-21          direction is in writing, and such personnel shall be 
  1-22          required to so notify the property owner or his or 
  1-23          her agent at the time of issuance of any such 
  1-24          direction;". 
 
  1-25                           SECTION 2. 
 
  1-26  Notwithstanding any provision of Code Section 1-3-4.1 of the 
  1-27  Official Code of Georgia Annotated to the contrary, this Act 
  1-28  shall become effective on July 1, 1998. 
 
  1-29                           SECTION 3. 
 
  1-30  All laws and parts of laws in conflict with this Act are 
  1-31  repealed.
