                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Part 3 of Article 16 of Chapter 2 of Title 20 of 
  1- 2  the Official Code of Georgia Annotated, relating to the 
  1- 3  health of students, so as to provide for preenrollment of 
  1- 4  children at two years of age in order to ensure compliance 
  1- 5  with age specific immunizations; to provide for certain 
  1- 6  exceptions; to provide for related matters; to provide for 
  1- 7  an effective date and applicability; to repeal conflicting 
  1- 8  laws; and for other purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Part 3 of Article 16 of Chapter 2 of Title 20 of the 
  1-12  Official Code of Georgia Annotated, relating to the health 
  1-13  of students, is amended by adding a new Code section, to be 
  1-14  designated as Code Section 20-2-771.1, to read as follows: 
 
  1-15    "20-2-771.1. 
 
  1-16    (a) As used in this Code section, the term 'certificate of 
  1-17    immunization' means certification by a physician licensed 
  1-18    under the laws of this state or by an appropriate official 
  1-19    of a local board of health, on a form provided by the 
  1-20    Department of Human Resources, that a named person has 
  1-21    been immunized in accordance with the applicable rules and 
  1-22    regulations of the Department of Human Resources. 
 
  1-23    (b) Each local board of education shall establish 
  1-24    procedures to provide for the preenrollment of children at 
  1-25    two years of age.  Such procedures shall include a 
  1-26    requirement that the child submit to the local board or to 
  1-27    a school within the school system a certificate of 
  1-28    immunization which indicates compliance with age specific 
  1-29    immunizations.  The Department of Human Resources shall 
  1-30    promulgate rules and regulations specifying those diseases 
  1-31    against which immunization is required and the standards 
  1-32    for such immunizations.

  2- 1    (c) If, after examination by the local board of health or 
  2- 2    any physician licensed under the laws of this state or of 
  2- 3    any other state having comparable laws governing the 
  2- 4    licensure of physicians, any child to whom this Code 
  2- 5    section applies is found to have any physical disability 
  2- 6    which may make vaccination undesirable, a certificate to 
  2- 7    that effect issued by the local board of health or such 
  2- 8    physician licensed under the laws of this or such other 
  2- 9    state may be accepted in lieu of a certificate of 
  2-10    immunization and shall exempt the child from the 
  2-11    requirement of obtaining a certificate of immunization 
  2-12    until the disability is relieved. 
 
  2-13    (d) This Code section shall not apply to a child whose 
  2-14    parent or legal guardian objects to immunization of the 
  2-15    child on the grounds that the immunization conflicts with 
  2-16    the religious beliefs of the parent or guardian; however, 
  2-17    the immunization may be required in cases when such 
  2-18    disease is in epidemic stages. For a child to be exempt 
  2-19    from immunization on religious grounds, the parent or 
  2-20    guardian must first furnish the responsible official of 
  2-21    the school or facility an affidavit in which the parent or 
  2-22    guardian swears or affirms that the immunization required 
  2-23    conflicts with the religious beliefs of the parent or 
  2-24    guardian." 
 
  2-25                           SECTION 2. 
 
  2-26  This Act shall become effective on January 1, 1998, and 
  2-27  shall apply to children who reach two years of age on or 
  2-28  after that date. 
 
  2-29                           SECTION 3. 
 
  2-30  All laws and parts of laws in conflict with this Act are
