                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend  an Act entitled "An Act to  provide a new charter 
  1- 2  for the City of Tifton," approved March 30, 1977 (Ga. L. 
  1- 3  1977, p. 4353), as amended, or, in the alternative, that Act 
  1- 4  introduced during the regular 1997 session of the General 
  1- 5  Assembly to provide a new charter for the City of Tifton if 
  1- 6  such Act becomes law, so as to change the corporate limits 
  1- 7  of the City of Tifton; to provide for a referendum; to 
  1- 8  provide for matters related to the foregoing; to provide an 
  1- 9  effective date; to repeal conflicting laws; and for other 
  1-10  purposes. 
 
  1-11       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-12                           SECTION 1. 
 
  1-13  An Act entitled "An Act to provide a new charter for the 
  1-14  City of Tifton," approved March 30, 1977 (Ga. L. 1977, p. 
  1-15  4353), as amended, is amended by inserting at the end of 
  1-16  Section 1.03 the following: 
 
  1-17    "(c) Notwithstanding the provisions of subsection (a) of 
  1-18    this section, the boundaries of the city shall include the 
  1-19    area described as follows: 
 
  1-20      All that land lying and being in the Sixth Land District 
  1-21      of Tift County, Georgia and being more particularly 
  1-22      described as follows:  For a beginning reference point, 
  1-23      commence at the intersection of the East Right of way 
  1-24      Line of Interstate Highway 75 with the North right of 
  1-25      way line of Brighton Road and from said beginning point,

  7- 1                           SECTION 2. 
 
  7- 2  If that Act to provide a new charter for the City of Tifton 
  7- 3  introduced during the regular 1997 session of the General 
  7- 4  Assembly becomes law, the above described boundaries, which 
  7- 5  are also described in Appendix "A" to such Act, shall 
  7- 6  describe the boundaries of the city for purposes of such 
  7- 7  Act. 
 
  7- 8                           SECTION 3. 
 
  7- 9  As soon as is permissible and reasonably practicable under 
  7-10  the federal Voting Rights Act of 1965, as amended, and under 
  7-11  the general laws of this state, the election superintendent 
  7-12  of  Tift County shall call and conduct an election for the 
  7-13  purpose of submitting this Act to the electors of Tift 
  7-14  County residing in the area described in Section 1 of this 
  7-15  Act but outside the existing municipal boundaries of the 
  7-16  city for approval or rejection.  The superintendent shall 
  7-17  cause the date and purpose of the election to be published 
  7-18  once a week for two weeks immediately preceding the date 
  7-19  thereof in the official organ of Tift County.  The ballot 
  7-20  shall have written or printed thereon the words: 
 
  7-21    "(  ) YES Shall the Act be approved which annexes 
  7-22              certain territory into the corporate limits of 
  7-23     (  ) NO  the City of Tifton?" 
 
  7-24  All persons desiring to vote for approval of the Act shall 
  7-25  vote "Yes," and those persons desiring to vote for rejection 
  7-26  of the Act shall vote "No."  If more than one-half of the 
  7-27  votes cast on such question are for approval of the Act, it 
  7-28  shall become of full force and effect immediately; otherwise 
  7-29  it shall be void and of no force and effect and shall be 
  7-30  automatically repealed upon the date the election results 
  7-31  are certified under this section. 
 
  7-32  The expense of such election shall be borne by the City of 
  7-33  Tifton.  It shall be the superintendent's duty to certify 
  7-34  the result thereof to the Secretary of State. 
 
  7-35                           SECTION 4. 
 
  7-36  This Act shall become effective upon its approval by the 
  7-37  Governor or upon its becoming law without such approval. 
 
  7-38                           SECTION 5. 
 
  7-39  All laws and parts of laws in conflict with this Act are 
  7-40  repealed.
