SB 722 96 LC 19 2983 SENATE BILL 722 By: Senators Newbill of the 56th and Stokes of the 43rd A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 20-2-51 of the Official Code of 1- 2 Georgia Annotated, relating to the election of members of 1- 3 local boards of education, so as to provide that a vacancy 1- 4 on the county board of education is created in each county 1- 5 when a member of the county board qualifies for nomination 1- 6 or election to any other elective governmental office; to 1- 7 repeal conflicting laws; and for other purposes. 1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 9 Code Section 20-2-51 of the Official Code of Georgia 1-10 Annotated, relating to the election of members of local 1-11 boards of education, is amended by striking subsection (d) 1-12 and inserting in lieu thereof the following: 1-13 "(d) In all counties of this state having a population of 1-14 not less than 500,000 or more than 600,000 according to 1-15 the United States decennial census of 1990 or any future 1-16 such census, the The members of the county boards of 1-17 education taking office after December 1, 1975 1996, shall 1-18 not hold any other elective governmental office. If any 1-19 member of any such board should qualify at any time after 1-20 December 1, 1975 1996, for nomination or election to any 1-21 other elective governmental office other than for 1-22 membership on such county board, such member's position on 1-23 such county board shall thereby become vacant. Such 1-24 vacancy shall be filled as provided by the law applicable 1-25 to any such county board." SECTION 2. 1-26 All laws and parts of laws in conflict with this Act are 1-27 repealed. S.
