SB 665 96 LC 27 0006 SENATE BILL 665 By: Senator Boshears of the 6th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Part 1 of Article 7 of Chapter 3 of Title 12 of the 1- 2 Official Code of Georgia Annotated, known as the "Jekyll 1- 3 Island--State Park Authority Act," so as to provide for 1- 4 annual fees that the Jekyll Island--State Park Authority may 1- 5 charge for fire protection and suppression services or 1- 6 public safety services; to provide an effective date; to 1- 7 repeal conflicting laws; and for other purposes. 1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 9 Part 1 of Article 7 of Chapter 3 of Title 12 of the Official 1-10 Code of Georgia Annotated, known as the "Jekyll 1-11 Island--State Park Authority Act," is amended by striking in 1-12 its entirety paragraph (23) of Code Section 12-3-235, 1-13 relating to the powers of the authority, and inserting in 1-14 lieu thereof a new paragraph (23) to read as follows: 1-15 "(23) To charge fees to all persons, natural and 1-16 artificial, using or relying upon fire protection and 1-17 suppression services or public safety services provided 1-18 by the authority or the Uniform Division of the 1-19 Department of Public Safety, which fees and each 1-20 installment thereof and the interest thereon shall be 1-21 liens against each tract of land benefited by the fire 1-22 protection and suppression services or public safety 1-23 services so provided from the date each such fee is 1-24 charged until fully paid; and such liens shall be 1-25 superior to all other liens, except liens for state and 1-26 county taxes and taxes levied for any and all school 1-27 purposes, and shall be collected by officers designated 1-28 by the authority in the same manner as state and county 1-29 taxes are collected. The annual amount of any fee 1-30 charged by the authority to any person, natural or 1-31 artificial, or upon any property owned or leased by any 1-32 such person under this paragraph shall not exceed the 1-33 annual amount which would be levied for such services by 1-34 the County of Glynn in the form of ad valorem taxes if S. B. 665 -1- (Index) LC 27 0006 2- 1 such services had been provided by the County of Glynn 2- 2 3.14 mills per dollar of the assessed value of such 2- 3 property, as such assessed value is determined by the 2- 4 Glynn County Board of Tax Assessors." SECTION 2. 2- 5 This Act shall become effective upon its approval by the 2- 6 Governor or upon its becoming law without such approval.
