HR 1013 LC 19 3018 A RESOLUTION 1- 1 Proposing an amendment to the Constitution so as to provide 1- 2 that the office of any federal, state, county, or municipal 1- 3 elected official who was elected as the nominee of a 1- 4 political party shall be vacated upon such elected official 1- 5 changing his or her political party affiliation during the 1- 6 term of office to which elected; to provide for the 1- 7 submission of this amendment for ratification or rejection; 1- 8 and for other purposes. 1- 9 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Article II, Section II of the Constitution is amended by 1-11 inserting a new Paragraph, to be designated Paragraph VI, to 1-12 read as follows: 1-13 "Paragraph VI. Vacancies created by elected officials 1-14 changing political parties. The office of any federal, 1-15 state, county, or municipal elected official in this state 1-16 who has been elected to such office as the nominee of a 1-17 political party shall be declared vacant upon such elected 1-18 official changing his or her political party affiliation 1-19 during the term of office to which elected. The vacancy 1-20 created in any such office shall be filled as provided by 1-21 this Constitution or any general or local law. SECTION 2. 1-22 The above proposed amendment to the Constitution shall be 1-23 published and submitted as provided in Article X, Section I, 1-24 Paragraph II of the Constitution. 1-25 The ballot submitting the above proposed amendment shall 1-26 have written or printed thereon the following: 1-27 "( ) YES Shall the Constitution be amended so as to 1-28 provide that the office of any federal, state, 1-29 ( ) NO county, or municipal elected official who was 1-30 elected as the nominee of a political party 1-31 shall be vacated upon such elected official 1-32 changing his or her political party 1-33 affiliation during the term of office to which -1- (Index) LC 19 3018 2- 1 elected?" 2- 2 All persons desiring to vote in favor of ratifying the 2- 3 proposed amendment shall vote "Yes." All persons desiring 2- 4 to vote against ratifying the proposed amendment shall vote 2- 5 "No." 2- 6 If such amendment shall be ratified as provided in said 2- 7 Paragraph of the Constitution, it shall become a part of the 2- 8 Constitution of this state. -2- (Index)
