HB 799 LC 24 0115 A BILL TO BE ENTITLED AN ACT 1- 1 To amend an Act providing for the establishment of a 1- 2 county-wide library system in Fulton County, approved April 1- 3 12, 1982 (Ga. L. 1982, p. 4174), as amended, particularly by 1- 4 an Act approved March 21, 1984 (Ga. L. 1984, p. 4711), and 1- 5 an Act approved March 24, 1988 (Ga. L. 1988, p. 4613), so as 1- 6 to change the membership and number of members of the 1- 7 library board of trustees; to provide for related matters; 1- 8 to provide an effective date; to repeal conflicting laws; 1- 9 and for other purposes. 1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-11 An Act providing for the establishment of a county-wide 1-12 library system in Fulton County, approved April 12, 1982 1-13 (Ga. L. 1982, p. 4174), as amended, particularly by an Act 1-14 approved March 21, 1984 (Ga. L. 1984, p. 4711), and an Act 1-15 approved March 24, 1988 (Ga. L. 1988, p. 4613), is amended 1-16 by striking Section 4 and inserting in lieu thereof a new 1-17 Section 4 to read as follows: "SECTION 4. 1-18 (a) Responsibility for constructing, operating, and 1-19 maintaining all library facilities and services within the 1-20 above-mentioned portions of Fulton County shall 1-21 hereinafter be vested in the county-wide library system 1-22 which shall be administered by the library board of 1-23 trustees. The members of the current library board of 1-24 trustees in office at the time of the effective date of 1-25 this section shall remain members of the library board of 1-26 trustees and shall serve in that capacity for the 1-27 remainder of their respective terms. 1-28 (b) The mayor of the City of Atlanta or his or her 1-29 designee shall serve on the library board of trustees in 1-30 an ex officio capacity. One member of the Atlanta City 1-31 Council shall be elected by the city council to serve as a 1-32 regular member on the library board of trustees. The -1- (Index) LC 24 0115 2- 1 chairperson of the Fulton County Board of Commissioners or 2- 2 his or her designee shall also serve on the library board 2- 3 of trustees in an ex officio capacity; and the board of 2- 4 commissioners shall elect one member from their board to 2- 5 serve as a regular member of the library board of 2- 6 trustees. 2- 7 (c) The Board of Commissioners of Fulton County shall 2- 8 appoint six members of such library board of trustees, and 2- 9 of such membership one member shall be a resident of a 2-10 municipality from the north Fulton area, one member shall 2-11 be a resident of a municipality from the south Fulton 2-12 area, one member shall be a resident from the special tax 2-13 district of the unincorporated area, and three members 2-14 shall be residents of the City of Atlanta. The 2-15 chairperson of the Fulton County Board of Commissioners 2-16 shall appoint a seventh member, who shall be a resident of 2-17 any area of Fulton County. 2-18 (d) The board of trustees shall nominate two persons to 2-19 fill each of five positions on the board of trustees, and 2-20 of the two persons so nominated for each position the 2-21 Board of Commissioners of Fulton County shall appoint one. 2-22 The nomination and appointment of members under this 2-23 subsection shall be made such that of these five members 2-24 at least one shall at all times be a resident of 2-25 unincorporated south Fulton County. 2-26 (e) On or before July 1, 1995, the mayor of the City of 2-27 Atlanta shall appoint one resident of DeKalb County within 2-28 the City of Atlanta to serve as a member of the library 2-29 board of trustees. 2-30 (f) All members of the board of trustees shall serve for 2-31 terms of four years expiring on June 30 of the final year 2-32 of the term. 2-33 (g) Members of the library board of trustees shall be 2-34 removed for cause or for failure to attend three 2-35 consecutive meetings pursuant to the bylaws of the library 2-36 board of trustees. 2-37 (h) The total membership of the board of trustees shall at 2-38 all times on and after July 1, 1995, consist of 17 2-39 members: four under subsection (b) of this section; seven 2-40 under subsection (c) of this section; five under 2-41 subsection (d) of this section; and one under subsection 2-42 (e) of this section. Successors shall be appointed in the 2-43 same manner as the members they succeed, so that the total -2- (Index) LC 24 0115 3- 1 membership of the board will always remain 17 members. 3- 2 Vacancies on the library board of trustees shall be filled 3- 3 in the same manner as initial appointments are made. If a 3- 4 vacancy occurs prior to the expiration of a trustee's 3- 5 term, the person who is appointed to fill that vacancy 3- 6 shall serve for the unexpired term." SECTION 2. 3- 7 This Act shall become effective upon its approval by the 3- 8 Governor or upon its becoming law without such approval. SECTION 3. 3- 9 All laws and parts of laws in conflict with this Act are 3-10 repealed. -3- (Index)
