HB 747 LC 22 1537 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 15-11-90 of the Official Code of 1- 2 Georgia Annotated, relating to the placement of a child 1- 3 following an order terminating parental rights, custodial 1- 4 authority, and placement review, so as to change the 1- 5 requirement for search for a family member for placement 1- 6 after parental rights are terminated; to provide a list of 1- 7 relatives who shall be considered for placement; to provide 1- 8 that other relatives shall be considered for placement in 1- 9 certain circumstances; to provide for related matters; to 1-10 repeal conflicting laws; and for other purposes. 1-11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-12 Code Section 15-11-90 of the Official Code of Georgia 1-13 Annotated, relating to the placement of a child following an 1-14 order terminating parental rights, custodial authority, and 1-15 placement review, is amended by striking in its entirety 1-16 paragraph (1) of subsection (a) and inserting in lieu 1-17 thereof a new paragraph to read as follows: 1-18 "(a)(1) If, upon the entering of an order terminating 1-19 the parental rights of a parent, there is no parent 1-20 having parental rights, the court shall first attempt to 1-21 place the child with the child's grandparent, adult 1-22 sibling, aunt, or uncle. extended family or with a 1-23 person related to the child by blood or marriage. An 1-24 exhaustive and thorough search for a suitable family 1-25 member A search for the child's grandparents, adult 1-26 siblings, aunts, and uncles shall be made by the court 1-27 and the Department of Human Resources in attempting to 1-28 effect this placement. Any other adult who is related to 1-29 the child by blood or by marriage who presents himself 1-30 or herself to the attention of the court shall be 1-31 eligible for consideration for permanent custody or 1-32 adoption of the child upon the same terms as a 1-33 grandparent, adult sibling, aunt, or uncle of the child. 1-34 A placement effected under this paragraph shall be -1- (Index) LC 22 1537 2- 1 conditioned upon the family member who is given 2- 2 permanent custody or who is granted an adoption of the 2- 3 child agreeing to abide by the terms and conditions of 2- 4 the order of the court." SECTION 2. 2- 5 All laws and parts of laws in conflict with this Act are 2- 6 repealed. -2- (Index)
