HB 738 LC 9 8226 A BILL TO BE ENTITLED AN ACT ddSECTION 1. 1- 7 An Act creating a new charter for the City of Lumpkin, 1- 8 approved March 23, 1977 (Ga. L. 1977, p. 3703), as amended 1- 9 by an Act approved March 28, 1990 (Ga. L. 1990, p. 4606), is 1-10 amended by adding, following Section 1.2A, a new Section 1-11 1.2B to read as follows: 1-12 "SECTION 1.2B. 1-13 In addition to any other territory lying within the 1-14 corporate limits of the City of Lumpkin, such city limits 1-15 shall also include the following described property: 1-16 EAST BROAD STREET CITY LIMITS 1-17 The Point of Beginning shall be the present City Limits 1-18 of the City of Lumpkin located on East Broad Street 1-19 which is Georgia Highway No. 27 and also known as the 1-20 Lumpkin to Richland Highway. From this Point of 1-21 Beginning run East along said highway an even width, 1-22 including all the right-of-way of said highway, for a 1-23 distance of two (2) miles. This point shall be the new 1-24 limits of the City of Lumpkin on East Broad Street and 1-25 Georgia Highway No. 27, East. Also to be annexed into 1-26 the City of Lumpkin is property abutting, facing and 1-27 lying on Georgia Highway 27, East, which west boundary 1-28 line of same is located 1.6 miles East of the present 1-29 (old) limits of the City of Lumpkin, fronting 1,309.35 1-30 feet on the South side of said highway and better 1-31 described as follows: -1- (Index) LC 9 8226 2- 1 All that tract or parcel of land situate, lying and 2- 2 being in Land Lot 18 of the 23rd Land District of 2- 3 Stewart County, Georgia, consisting of thirty (30) 2- 4 acres, more or less, and being more particularly 2- 5 described according to a plat of Survey for Stewart 2- 6 County Board of Education, by Langford & Associates, 2- 7 Inc. and dated 11 May 1989, as follows: 2- 8 Beginning at the concrete monument marking the 2- 9 intersection of the southern right-of-way of Georgia 2-10 Highway 27 and the East line of Land Lot 18 and 2-11 running thence North 81 degrees 55 minutes 00 seconds 2-12 West for 1,251.53 feet along said right-of-way to an 2-13 iron pin marking the Point of Beginning. From this 2-14 Point of Beginning run South 02 degrees 31 minutes 27 2-15 seconds West 785.65 feet to an iron pin; thence, North 2-16 87 degrees 17 minutes 38 seconds West 223.55 feet to 2-17 an iron pin; thence South 36 degrees 42 minutes 42 2-18 seconds West 400.25 feet to an iron pin; thence, North 2-19 54 degrees 17 minutes 26 seconds West 314.45 feet to 2-20 an iron pin; thence, North 89 degrees 17 minutes 17 2-21 seconds West 591.98 feet to an iron pin; thence, North 2-22 02 degrees 31 minutes 27 seconds East for 1,089.31 2-23 feet to an iron pin on the southern right-of-way of 2-24 Georgia Highway 27; thence, South 81 degrees 55 2-25 minutes 00 seconds East 1,309.35 feet along said 2-26 right-of-way of Georgia Highway 27 to the iron pin 2-27 marking the Point of Beginning. 2-28 The above-described property is bounded on the North 2-29 by Georgia Highway 27 and on the East, South, and West 2-30 by property owned by Mrs. Oliver S. Morton, Sr., 2-31 Oliver S. Morton, Jr., Jeanne Morton, and Franklyn A. 2-32 Klassi and Joseph A. Hubert as Co-Trustees Under the 2-33 Will of Elizabeth Morton Klassi, deceased, for the 2-34 benefit of Franklyn A. Klassi. 2-35 The above Described Property is Owned by the Stewart 2-36 County School District and is the Location of the 2-37 Stewart County Elementary School. 2-38 SOUTH CHESTNUT STREET CITY LIMITS 2-39 The Point of Beginning shall be the present City Limits 2-40 of the City of Lumpkin located on South Chestnut Street, 2-41 which is U.S. Highway No. 27 and Georgia Highway No. 1, 2-42 also known as the Cuthbert Highway. From This Point of 2-43 Beginning, run South along said highway an even width, -2- (Index) LC 9 8226 3- 1 including all the right-of-way of said highway, for a 3- 2 distance of two (2) miles. This Point shall be the new 3- 3 limits of the City of Lumpkin on South Chestnut Street, 3- 4 which is U.S. Highway No. 27 and Georgia Highway No. 1, 3- 5 also known as the Cuthbert Highway. 3- 6 OLD CHESTNUT STREET CITY LIMITS 3- 7 The Point of Beginning shall be the present City Limits 3- 8 of the City of Lumpkin located on Old Chestnut Street, 3- 9 which is County Road No. 149. From this Point of 3-10 Beginning, Run in a Southwesterly direction along said 3-11 road an even width, including all the right-of-way of 3-12 said road, for a distance of 2.3 miles. This point 3-13 shall be the new limits of the City of Lumpkin on Old 3-14 Chestnut Street. Also to be annexed into the City of 3-15 Lumpkin is property owned by the Stewart County School 3-16 District and abutting, facing and lying on the South 3-17 side of County Road No. 149, the East boundary of which 3-18 is 1.8 miles from the present (old) limits of the City 3-19 of Lumpkin, and runs along the South side of said road a 3-20 distance of 3168 feet in a westerly direction to County 3-21 Road 113 and the West line of Land Lot No. 233 of the 3-22 20th Land District of Stewart County, Georgia, which is 3-23 the Point of the new limits of the City of Lumpkin on 3-24 Old Chestnut Street. The following described property 3-25 is owned by the Stewart County School District and upon 3-26 which is located the Stewart-Quitman High School. 3-27 ALL THAT TRACT OR PARCEL OF LAND lying and being in 3-28 Land Lots No. 233 and 248 in the 20th Land District of 3-29 Stewart County, Georgia, containing 32 acres, more or 3-30 less, and lying in one body along the West side of 3-31 said lots of land, and described more particularly as 3-32 being enclosed within the following lines, to-wit: 3-33 Beginning at a point in the center of a county road 3-34 running East and West through lot of land 248 near the 3-35 South line of said Land Lot and which point is 11.25 3-36 chains East of the West line of Land Lot 248; thence 3-37 run in an easterly direction along the center of said 3-38 county road (South 89 degrees 30 minutes East) the 3-39 distance of 5.53 chains; thence southerly (South 18 3-40 degrees 30 minutes West) the distance of 27.60 chains 3-41 into lot of land 233; thence westerly (North 86 3-42 degrees 15 minutes West) the distance of 7.85 chains 3-43 to the West line of Land Lot 233; thence North (North 3-44 0 degrees 15 minutes West) along the West line of Land -3- (Index) LC 9 8226 4- 1 Lot 233 and 248 to the center of the aforementioned 4- 2 county paved road where it intersects the West line of 4- 3 said Land Lot; thence in an easterly direction along 4- 4 the center of said public road for a distance of 11.25 4- 5 chains to the place or point of beginning. Said 4- 6 parcel of land is presently bounded on the North by 4- 7 the public paved county road known as the Old Lumpkin 4- 8 to Eufaula Highway; on the East and South by lands of 4- 9 Georgia Kraft Company; and on the West by the land lot 4-10 line and beyond that, lands in possession of St. Regis 4-11 Paper Company. The above-described property is a 4-12 portion of the lands conveyed by George P. Swift, III 4-13 to William Henry Williams, Sr. by a Warranty Deed 4-14 dated January 28, 1977, and recorded in the Office of 4-15 the Clerk of the Stewart County Superior Court, Deed 4-16 Book 60, Pages 160-162. 4-17 ALSO: 4-18 All that certain real estate situated and being in the 4-19 20th Land District of Stewart County, Georgia, 4-20 containing 29.5193 acres, more or less, and consisting 4-21 of the following known lands: 4-22 A portion of the Southeast one-quarter of Lot 249 4-23 lying South of the center line of Georgia State Road 4-24 PR-2843, continuing 3.6915 acres, more or less; 4-25 And a portion of the Northwest one-quarter of Lot 232, 4-26 continuing 25.8278 acres, more or less; 4-27 And being more particularly described as follows: 4-28 For the Point of Beginning commence at a concrete 4-29 monument located a the Northeast corner of Lot 232 of 4-30 the 20th Land District of Stewart County, Georgia; run 4-31 thence South 0 degrees 42 minutes 07 seconds West, 4-32 along the East line of said Lot 232 a distance of 4-33 23.5878 chains to a concrete monument located in the 4-34 centerline of an old road; run thence along said 4-35 centerline to a one-half inch iron pipe lying North 87 4-36 degrees 06 minutes 24 seconds West a distance of 4-37 2.8686 chains from said concrete monument; continue 4-38 thence along said centerline to a concrete monument 4-39 lying North 81 degrees 44 minutes 54 seconds West a 4-40 distance of 8.2936 chains from said iron pipe, run 4-41 thence North 0 degrees 11 minutes 52 seconds West a 4-42 distance of 24.7003 chains to a concrete monument 4-43 located in Lot 249 of said 20th Land District at a -4- (Index) LC 9 8226 5- 1 point on the Southerly line of the 80 foot 5- 2 right-of-way of Georgia State Road PR-2843; continue 5- 3 thence North 0 degrees 11 minutes 52 seconds West a 5- 4 distance of 0.6061 chains to a point in the centerline 5- 5 of said 80 foot right-of-way; run thence North 89 5- 6 degrees 06 minutes 22 seconds East along said 5- 7 centerline a distance of 11.4900 chains to the point 5- 8 of intersection of said centerline with the East line 5- 9 of said Lot 249; run thence South 0 degrees 42 minutes 5-10 07 seconds West along said East line of Lot 249 a 5-11 distance of 3.2348 chains to the concrete monument and 5-12 Point of Beginning of the land thus described. 5-13 WEST BROAD STREET CITY LIMITS 5-14 The Point of Beginning shall be the present City Limits 5-15 of the City of Lumpkin located on West Broad Street 5-16 which is Georgia Highway No. 27 and also known as the 5-17 Lumpkin to Eufaula, Alabama highway. From this point of 5-18 beginning, run West along said highway and even width, 5-19 including all the right-of-way of said highway, for a 5-20 distance of two (2) miles. This point shall be the new 5-21 limits of the City of Lumpkin on West Broad Street and 5-22 Georgia Highway No. 27, West. 5-23 FLORENCE STREET CITY LIMITS 5-24 The Point of Beginning shall be at the present City 5-25 Limits of the City of Lumpkin located on Florence Street 5-26 which is Georgia Highway 39 C. From this Point of 5-27 Beginning, run in a Westerly direction an even width, 5-28 including all the right-of-way of said highway, a 5-29 distance of two (2) miles. This point shall be the new 5-30 limits of the City of Lumpkin on Georgia Highway 39 C 5-31 which is also Florence Street. 5-32 NORTH CHESTNUT STREET CITY LIMITS 5-33 The Point of Beginning shall be the present City Limits 5-34 of the City of Lumpkin located on North Chestnut Street 5-35 which is U.S. Highway No. 27, Georgia Highway No. 1 and 5-36 also known as the Lumpkin to Columbus highway. From 5-37 this Point of Beginning, run North an even width along 5-38 the right-of-way of said highway a distance of two (2) 5-39 miles. This point shall be the new limits of the City 5-40 of Lumpkin on North Chestnut Street which is U. S. 5-41 Highway 27 North and Georgia Highway No. 1. -5- (Index) LC 9 8226 6- 1 VALLEY ROAD CITY LIMITS 6- 2 The Point of Beginning shall be the present City Limits 6- 3 of the City of Lumpkin located on the Valley Road also 6- 4 known as County Road No. 49. From this Point of 6- 5 Beginning, run in a Northeasterly direction an even 6- 6 width, including all the right-of-way of way of said 6- 7 road, for a distance of two (2) miles. This point shall 6- 8 be the new limits of the City of Lumpkin on the Valley 6- 9 Road, County Road No. 49. 6-10 EAST MAIN STREET CITY LIMITS 6-11 The Point of Beginning shall be the present City Limits 6-12 of the City of Lumpkin located on East Main Street, 6-13 County Road No. 79, also known as the James Holder Road. 6-14 From this Point of Beginning, run in a Easterly 6-15 direction an even width, including all the right-of-way 6-16 of said road, for a distance of two (2) miles. This 6-17 point shall be the new limits of the City of Lumpkin on 6-18 East Main Street, County Road No. 79, also known as the 6-19 James Holder Road. 6-20 DR. MARTIN LUTHER KING, JR. DRIVE CITY LIMITS 6-21 The Point of Beginning shall be the present City Limits 6-22 of the City of Lumpkin located on Dr. Martin Luther 6-23 King, Jr. Drive (South), County Road No. 148, also known 6-24 as Trotman Road. From this Point of Beginning, run in a 6-25 Southerly direction an even width, including all the 6-26 right-of-way of said road, for a distance of two (2) 6-27 miles. This Point shall be the new limits of the City 6-28 of Lumpkin on Dr. Martin Luther King, Jr. Drive (South), 6-29 County Road No. 148, also known as Trotman Road." SECTION 2. 6-30 All laws and parts of laws in conflict with this Act are 6-31 repealed. -6- (Index)
