HB 678 LC 24 0110-EC A BILL TO BE ENTITLED AN ACT 1- 1 To amend Subpart 2 of Part 6 of Article 6 of Chapter 2 of 1- 2 Title 20 of the Official Code of Georgia Annotated, relating 1- 3 to conditions of employment for teachers, so as to provide 1- 4 for a salary increase for those persons who have received 1- 5 certification from the National Board for Professional 1- 6 Teaching Standards; to provide policies and restrictions 1- 7 connected therewith; to provide for related matters; to 1- 8 provide for an effective date; to repeal conflicting laws; 1- 9 and for other purposes. 1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-11 Subpart 2 of Part 6 of Article 6 of Chapter 2 of Title 20 of 1-12 the Official Code of Georgia Annotated, relating to 1-13 conditions of employment for teachers, is amended by adding 1-14 a new Code Section 20-2-212.2 to read as follows: 1-15 "20-2-212.2. (Index) 1-16 (a) As used in this Code section, 'national certification' 1-17 means certification obtained from the National Board for 1-18 Professional Teaching Standards. 1-19 (b) Any person who: 1-20 (1) Is currently teaching in a Georgia public school and 1-21 holds a valid Georgia teaching certificate; 1-22 (2) Has completed three years of teaching in Georgia 1-23 public schools prior to receiving national 1-24 certification; 1-25 (3) Has not previously received state funds for 1-26 participating in any certification area in the national 1-27 certification program; and 1-28 (4) Has successfully completed the prerequisite 1-29 portfolio of student work and examination and has 1-30 received national certification -1- (Index) LC 24 0110-EC 2- 1 shall receive a 5 percent rate increase in state salary. 2- 2 Such increase shall be awarded on the commencement of the 2- 3 school year following such certification. The increase in 2- 4 state salary provided by this Code section shall be in 2- 5 addition to any other increase for which the person is 2- 6 eligible. 2- 7 (c) The national certification program participation fee 2- 8 shall be reimbursed by the state upon certification for 2- 9 any teacher who is eligible for an increase pursuant to 2-10 subsection (a) of this Code section. 2-11 (d) A teacher for whom the State of Georgia pays the 2-12 participation fee and who does not teach in a Georgia 2-13 public school for at least one year after receiving 2-14 certification shall repay the certification fee to the 2-15 state. Repayment is not required if the teacher is unable 2-16 to complete the additional year of teaching due to the 2-17 death or disability of the teacher." SECTION 2. 2-18 This Act shall become effective upon its approval by the 2-19 Governor or upon its becoming law without such approval. SECTION 3. 2-20 All laws and parts of laws in conflict with this Act are 2-21 repealed. -2- (Index)
